Section 123(1) of RP Act and 171B/171E of IPC defines bribery as a corrupt practice as well as an electoral offence. The section vide clause (1) (i) says that whoever gives a gratification to any person with the object of inducing him or any other person to exercise any electoral right or of rewarding any person for having exercised any such right, commits the offence of bribery.

Promoting enmity between classes in connection with election: S ec 125 of RPA Act 1951, 153 A of 1960
Any person who in connection with an election, under this Act promotes or attempts to promote on grounds of religion, race, caste, community or language, feelings of enmity or hatred, between different classes of the citizens of India shall be punishable with imprisonment for a term which may extend to three years, or with fine which may extend to ten thousand rupees or with both.

The Constitution makers, nor the PIL jurists would have envisioned that one day a person will have to move to the court begging for a hospital bed.

Apparently the Hon'ble judges while hearing the petition said, "What can we do!"

Indeed, this level of mismanagemnt was never apprehended in the Constituional Jurisprudence. Our constitution also seems helpless here.

Even though Right to property was removed as a fundamental Right, it is still a precious Constitutional Right, and a part of Right to Life and Personal Liberty under Article 21 of the Constitution of India.

There is no legal backing of the UP CM's order of seizure of property of those alleging shortage of Oxygen, bed and medicines in the State, before even they face a trial, even if there was such a provision, it would be on a precarious footing and its legal validity would have to be tested in light of Right to Free speech and expression.

Its sad that the government in this time of crisis is resorting to pressure tactic rather than addressing the real issues at hand.
