I was one of the Fact Finding Committee members, appointed by the All India Lawyers' Union (AILU) State Committee into the murder of Advocate Dattappa Laxman Bandivaddar of Sindagi taluk in Vijayapura district last week. Advocates from various parts of Karnataka namely Sri. Koteshwar Rao of Bellary, Sri. A. Karunanidhi of Hospet, Sri. R Jagannath of Mandya, Sri. Srinivas Kumar of Malavalli, Sri P S Ramesh of Bangalore and myself were in the team to find out the truth behind the incident. All of us visited the village of slain lawyer on 7th November and met his mother, sister and blind brother apart from villagers and neighbours. Later we met Sindagi Bar Association members and a few leaders of social organisations of the district.
40-year old Dattappa was mostly a civil layer who took up cases of his community members. He belonged to Bovi and was active in Bovi Yuva Vedike. On 31st October, when he was on the way to his village, Belaganoora, on his bike by 8.00 pm, the assailants chased him on another bike and hit him on his back with sharp weapons. When he fell down, the assailants repeatedly stabbed him. Hearing the screams of Dattappa, a few farmers came running to the spot to take to the hospital. He died in Vijayapura in the early hours on 1st November.
Three have been in judicial custody in connection with the murder. Since SC/ST Atrocities Act is attracted, DySP is the Investigation Officer. Charge sheet is to be ready.
Lawyer Dattappa had filed Vakalath to implead a person as defendant No.2 in O.S.81/2017 in the court of senior civil judge, Sindagi. It was collusion suit for specific performance. The impleading of defendant No.2 was a headache for the plaintiff. He had made threats to Dattappa several times in the court premises. In fact, there was a conspiracy to kill Dattappa for 15 days, according to police sources. However, police has not included Sec.120 B (criminal conspiracy) in the FIR. Still a few people who are the conspirators of the murder are still at large. They need to be brought under the law.
We did not find any political connections in the murder. Nevertheless, the brutal murder of Dattappa is really frightening. Where is the protection for a lawyer? If this could be the situation, what is the fate of lawyers in the country?
A lawyer from Dandeli of Uttara Kannada district, Anand Nayak was shot dead recently. The murder of Dattappa is the second in the series. It is really terrific. All the lawyers in the profession must take it seriously and demand for a Protection Law for lawyers. It is the need of the hour.
