अभिलेख उपस्थापित। परिवादी प्रवीण कुमार, पिता-स्व0 राम बल्लभ शर्मा, ग्राम+पोस्ट-महसौरा, प्रखंड-रामगढ़ चौक, जिला-लखीसराय अनुपस्थित। परिवादी को उपस्थित होने हेतु डाक से सूचना भेजी गई थी। लोक प्राधिकार सहायक विधुत अभियंता, विधुत आपूर्ति अवर प्रमंडल, लखीसराय उपस्थित। परिवादी ने ‘‘महसौरा उ0 वि0 तालाब के निकट से मात्र 600 मीटर पूरब में बिसुआ मोहन तक बिजली पहुँचाने का कष्ट करें ताकि वन एवं पर्यावरण की रक्षा हो सके। मछली पालन एवं हजारों पौधे जलाभाव में मुरझा रहे हैं। कनेक्शन के लिए आवेदन दिया गया है और दर्जनों किसान तैयार हैं।’’ के संबंध में परिवाद दायर किया है। प्रस्तुत परिवाद के संबंध में लोक प्राधिकार सहायक विधुत अभियंता, विधुत आपूर्ति अवर प्रमंडल, लखीसराय ने पत्रांक-447, दिनांक-26.06.19 द्वारा प्रतिवेदन किया है कि ‘‘परिवादी श्री प्रवीण कुमार, ग्राम+पोस्ट-महसौरा, थाना-रामगढ़ चौक, जिला-लखीसराय के शिकायत की जाँच कनीय विद्युत अभियंता, विद्युत आपूर्ति प्रशाखा, रामगढ़ चौक के द्वारा किया गया। जाँचोपरांत पाया गया कि जहाँ परियोजना के माध्यम से ट्रांसफर्मर एवं तार लगा दिया गया वहाँ 30 दिनों के अन्दर विद्युत संबंध बहाल कर दिया जायेगा। अन्य सभी आवेदकों के विरूद्ध परियोजना द्वारा ट्रांसफर्मर एवं तार लगा कर 31.12.2019 तक विद्युत आपूर्ति बहाल करने का लक्ष्य निर्धारित किया गया है। अतः भवदीय से अनुरोध है कि उक्त परिवाद को समाप्त करने की कृपा की जाय।’’ अतः लोक प्राधिकार सहायक विधुत अभियंता, विधुत आपूर्ति अवर प्रमंडल, लखीसराय ने पत्रांक-447, दि0-26.06.2019 के उपर्युक्त वर्णित प्रतिवेदन के आधार पर प्रस्तुत परिवाद को स्वीकृत करते हुए प्रस्तुत परिवाद की कार्यवाही समाप्त की जाती है।

first ten cases to enable the opposite parties to file additional
show cause indicating the details of the action taken by them in
the light of the direction issued by the Tribunal which was
approved by the writ court so far as this petitioner, Saurabh
Kumar Ram is concerned.
The District Education Officer directed to inform the
concerned Panchayat Secretary to remain physically present in
Court on the next date 23rd September, 2019 along with the
relevant records to assist the Court. The Dealing Assistant
attached to the office of the District Education Officer is also
required to be physically present on the next date.

An Act further to amend the Negotiable Instruments Act, 1881.
BE it enacted by Parliament in the Sixty-ninth Year of the Republic of India as
follows:—
1. (1) This Act may be called the Negotiable Instruments (Amendment) Act, 2018.
(2) It shall come into force on such date as the Central Government may, by
notification in the Official Gazette, appoint.
2. In the Negotiable Instruments Act, 1881 (hereinafter referred to as the principal
Act), after section 143, the following section shall be inserted, namely:—
‘‘143A. (1) Notwithstanding anything contained in the Code of Criminal
Procedure, 1973, the Court trying an offence under section 138 may order the drawer
of the cheque to pay interim compensation to the complainant—
(a) in a summary trial or a summons case, where he pleads not guilty to
the accusation made in the complaint; and

Lawyers should be exempted from toll fee under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (framed under the National Highways Act, 1956).

National Highways Fee (Determination of Rates and Collection) Rules, 2008 framed under the National Highways Act, 1956 provide for levy fee for use of any section of national highway, permanent bridge, bypass or tunnel forming part of the national highway, as the case may be, in accordance with the provisions of these rules: Provided that the Central Government may, by notification, exempt any section of national highway, permanent bridge, bypass or tunnel constructed through a public funded project from levy of such fee or part thereof, and subject to such conditions as may be specified in that notification.

Rule 11 speaks about exemption from payment of fee and says that the following persons are exempted from payment of fee. It says that no fee shall be levied and collected from a mechanical vehicle

(a) transporting and accompanying�
(i) the President of India;
(ii) the Vice-President of India;
(iii) the Prime-Minister of India;
(iv) the Governor of a State;
(v) the Chief Justice of India;
(vi) the Speaker of the House of People;
(vii) the Cabinet Minister of the Union;
(viii) the Chief Minister of a State;
(ix) the Judge of the Supreme Court;
(x) the Minister of State of the Union;
(xi) the Lieutenant Governor of a Union territory;
(xii) the Chief of Staff holding the rank of full General or equivalent rank;
(xiii) the Chairman of the Legislative Council of a State;
(xiv) the Speaker of the Legislative Assembly of a State;
(xv) the Chief Justice of a High Court;
(xvi) the Judge of a High Court;
(xvii) the Member of Parliament;
(xviii) the Army Commander or Vice-Chief of Army Staff and equivalent in other services;
(xix) the Chief Secretary to a State Government within concerned State;
(xx) the Secretary to the Government of India;
(xxi) the Secretary, Council of States;
(xxii) the Secretary, House of People;
(xxiii) the Foreign dignitary on State visit;
(xxiv) The Member of Legislative Assembly of a State and the Member of Legislative Council of a State within their respective State, if he or she produces his or her identity card issued by the concerned Legislature of the State;
(xxv) the awardee of Param Vir Chakra, Ashok Chakra, Maha Vir Chakra, Kirti Chakra, Vir Chakra and Shaurya Chakra, if such awardee produces his or her photo identity card duly authenticated by the appropriate or competent authority for such award;
(b) used for official purposes by�
(i) the Ministry of Defence including those which are eligible for exemption in accordance with the provisions of the Indian Toll (Army and Air Force) Act, 1901 and rules made thereunder, as extended to Navy also;
(ii) the Central and State armed forces in uniform including para military forces and police;
(iii) an executive Magistrate;
(iv) the fire-fighting Department or organisation;
(v) the National Highways Authority of India or any other Government organisation using such vehicle for inspection, survey, construction or operation of national highways and maintenance thereof;
(c) used as ambulance; and
(d) used as funeral van.

The primary reason for granting exemption to may personalities mentioned above is that these people are in public life doing public service and hence cannot be burdened with toll fee.

It may be noted that advocates travel on working days only for the purpose of attending their clients’ cases. No lawyer will travel outstation on working day except for attending their cases. Moreover, the Court Commissioners and Receivers etc act on behalf of Courts and hence considered as Officers of Court.

If being in public life and doing work for the society at large is the criteria, lawyers are certainly entitled to exemption. The to and fro toll fee in some roads exceed Rs.200 to 400. If the matter is adjourned day-to-day, it is practically impossible to afford such high burden. Such fee cannot be charged to a client especially when the client is poor and dependent on agriculture or manual labour.

The Advocates Association, Bangalore has taken up the issue and in the coming days it will be a nationwide movement to exempt lawyers from paying toll fee.
