The Supreme Court has set aside the murder conviction, after finding that the prosecution's recovery of evidence based on the accused's disclosure statements under Section 27 of the Evidence Act was riddled with inconsistencies, hostile witnesses, and a lack of forensic linkage.

In a major ruling, the Madhya Pradesh High Court clarified that a Muslim man cannot be prosecuted for bigamy under Section 494 IPC if his personal law permits multiple marriages. The Court made it clear, bigamy applies only when the second marriage is legally void. But under Muslim Personal Law, polygamy is recognized, so that condition simply doesn’t exist here.

However, the story doesn’t end there, while the bigamy charge was quashed, serious allegations like cruelty, assault, and criminal intimidation will still go to trial. The Court’s key observation, “Essential ingredient of Section 494 IPC is not satisfied.”
