Divisional Joint Registrar Circular dated 01/06/2023 regarding investing funds of the Housing Societies in District Central Co-operative Bank / MSC Bank as per Section 154B(17) of MCS Act

Managing Committee of Co-operative Housing Society in Mumbai is *liable to be disqualified* if the bank account opened and FDs are kept in any bank(s) other than MSC Bank or Mumbai Bank.

*MCS Act, 1960*

*Section 154B-17*

A society shall invest or deposit its funds in one or more of
the following :—

(a) in a District Central Co-operative Bank, the State Co-operative
Bank, having awarded at least “A” Audit Class in last three consecutive
years, if no such Central Co-operative Bank is available in district, then
any Nationalised Bank ;

(b) in any of the securities specified in section 20 of the Indian Trusts
Act, 1882 ;

(c) in the shares, or security bonds, or debentures, issued by any
other society with limited liability ;

(d) in any other mode permitted by the rules, or by general or special
order issued in that behalf by the State Government.

The Hon’ble Bombay High Court has observed that giving less than 24 hours’ notice or short notice of hearing is against the principles of natural justice.

"“…..State of Maharashtra is directed that in all those
matters where personal hearing has to be given, *they shall give minimum 5 working days notice to all parties in every matter*, and that applies to this matter as well. This is a direction that shall apply to personal hearing before every authority."

All the Authorities and departments are, therefore, instructed to strictly adhere to the aforementioned directions of the Hon’ble High Court with regard to ‘Notice period’ to the parties concerned for personal hearing, before various Authorities to ensure Natural Justice.

Non-compliance of the said directions may result in imposition of cost by the Hon'ble Court to be recovered from the salary of the Principal Secretary of the concerned Department.

If such a Resolution is not passed in AGM/SGM, then society can't charge Non-Occupancy Charges.

Big Housing Societies are being targeted by the Drug Peddlers due to its complex structure of Basement Parking, Weak Security Surveillance and "Why Should I Complaint" attitude by Managing Committees.

*What to do if Consumer of Drugs or Peddlers of Drugs are found in the Society ?*

Instead of doing investigation on their own, the Managing Committee of the Society shall inform the incidents related to Consumption of Drugs or Peddling of Drugs to nearest Police Station and Anti-Narcotics Cell immediately. The CCTV footage related to the incident shall be preserved utill the Police Investigation is over and shall be handed over to the police, if asked.

Protecting the persons related to drugs racket and deletion of CCTV footage or destroying the evidences is a Crime and may land the persons responsible to it, in Jail.

As per the guidelines, disclosures should be placed in the endorsement message in such a manner that they are clear, prominent and extremely hard to miss.

As per the guidelines, disclosures should be placed in the endorsement message in such a manner that they are clear, prominent and extremely hard to miss.

Consumer Affairs Ministry on January 20 released endorsement guidelines for social media influencers. A fine of Rs 10 lakh will be slapped on the offenders, which can go up to Rs 50 lakh for repeated offenders, the ministry said. The influencer can even be barred from endorsing products for up to 6 years in case of repeated non-compliance of the guidelines, it added.
