On this day of Navratri, we celebrate *Kushmanda*, the goddess who radiates the warmth of creation and sustains the universe with her smile. Just as she brings light and life, it is our responsibility to protect the lives of our children, the future of our world.

2/ Our children, like the light of Kushmanda, are precious and vulnerable. They need our care and protection. The Juvenile Justice (Care and Protection of Children) Act, 2015 exists to ensure that every child in need is provided safety, shelter, and a future filled with hope.

3/ What does the law ensure?
✨ Provides care, protection, and rehabilitation for children in conflict with law and those in need of care
✨ Focuses on rehabilitation through counseling, adoption, and foster care
✨ Ensures child-friendly courts and legal processes
✨ Protects children from abuse, exploitation, and neglect


4/ Like Kushmanda, who nurtures creation, the Juvenile Justice Act is designed to nurture our most vulnerable, offering them second chances and safe environments to grow. No child should be lost to neglect, poverty, or exploitation.

Today, we invoke Chandraghanta, the goddess who symbolizes courage, power, and justice. She stands tall, ready to confront evil and restore balance. Her fierce determination reminds us of the strength within every woman who faces injustice.

2/ But even in our modern world, women continue to face violence—often in their own homes. Domestic violence is a hidden battle many women fight every day. In India, the Protection of Women from Domestic Violence Act, 2005 serves as a shield, offering legal recourse to survivors.

3/ What does this law do?
✨ Provides protection orders to safeguard women
✨ Ensures residence rights—women cannot be forced out of their homes
✨ Offers monetary relief and custody of children
✨ Protects women from physical, emotional, verbal, sexual, and economic abuse

ABOUT:

It is a watchdog of human rights in the country, i.e. the rights related to life, liberty, equality and dignity of the individual guaranteed by Indian Constitution or embodied in the international covenants and enforceable by courts in India.

ESTABLISHMENT:

It is established on 12th October, 1993, under Protection of Human Rights Act (PHRA), 1993.
It was amended by the Protection of Human Rights(Amendment) Act, 2006 and Human Rights (Amendment) Act , 2019 It was established in conformity with the Paris Principles, adopted for the promotion and protection of human rights in Paris (October, 1991) and endorsed by the General Assembly of the United Nations in December, 1993.

COMPOSITION:

Key Members: It is a multi-member body consisting of a chairman and four members. A person who has been the Chief Justice of India or a judge of the Supreme Court is a chairman.

Appointment: The chairman and members are appointed by the President on the recommendations of a six-member committee consisting of the Prime Minister as its head, the Speaker of the Lok Sabha, the Deputy Chairman of the Rajya Sabha, Leander of opposition in both the Houses of Parliament and the Union Home Minister.

Tenure: The chairman and members hold office for a term of three years or until they attain the age of 70 years, whichever is earlier. z The President can remove the chairman or any member from the office under some circumstances.

ROLE AND FUNCTION:

It has all the powers of a civil court and its proceedings have a judicial character.
It is empowered to utilise the services of any officer or investigation agency of the Central government or any state government for the purpose of investigating complaints of human rights violation.
It can look into a matter within one year of its occurrence, i.e the Commission is not empowered to inquire into any matter after the expiry of one year from the date on which the act constituting violation of human rights is alleged to have been committed.
The functions of the commission are mainly recommendatory in nature.

REGISTRATION OF BIRTH AND DEATH:

Registration of Births and Deaths in India is mandatory with the enactment of Registration of Births and Deaths (RBD), Act 1969 and is done as per the place of occurrence of the event.
With a view to simplify the provisions of various sections of the existing RBD Act, 1969 and to make it people friendly, the amendment has been proposed.

PROPOSED AMENDMENTS:

1. Chief Registrar to maintain Unified Data:

The Chief Registrar (appointed by the States) would maintain a unified database at the State level and integrate it with the data at the “national level,” maintained by the Registrar General of India (RGI) (under the Ministry of Home Affairs) .
Presently, the registration of births and deaths is done by the local registrar appointed by States.

2. Special Sub-Registrars:

The appointment of “Special Sub-Registrars, in the event of disaster, with any or all of his powers and duties for on the spot registration of deaths and issuance of extract thereof, as may be prescribed.”

EXPECTED USE OF THE DATA:

To update the National Population Register (Citizenship Act, 1955) and the electoral register (Registration of Electors Rules, 1960), and Aadhaar (Aadhaar Act, 2016), ration card (National Food Security Act, 2013), passport (Passport Act) and driving licence databases (Motor Vehicles (Amendment) Act, 2019).

The NPR already has a database of 119 crore residents and under the Citizenship Rules, 2003, it is the first step towards the creation of the National Register of Citizens (NRC).

The NPR update and the first phase of Census will be conducted simultaneously by the RGI.

- ऑस्ट्रेलियात मुलांना लक्ष्य करणाऱ्या ऑनलाइन जाहिरातींना आळा घालण्यासाठी यापुढे फेसबुकसारख्या समाजमाध्यमांना त्यांची सेवा १६ वर्षांखालील मुलांना उपलब्ध करून देण्याआधी या मुलांच्या पालकांची संमती घेणे आवश्यक ठरणार आहे. तशा कायद्याचा मसुदा सोमवारी ऑस्ट्रेलिया सरकारने जाहीर केला. या अटीची पूर्तता न केल्यास संबंधित कंपनीस १० दशलक्ष डॉलरचा दंड ठोठावण्याची तरतूद प्रस्तावित करण्यात आली आहे.

- या महत्त्वपूर्ण विधेयकामुळे नागरिकांना ऑनलाइन माध्यमांत संरक्षण मिळणार असून व्यक्तिगततेचे कायदे डिजिटल युगाशी सुसंगत केले जात असल्याचे ऑस्ट्रेलिया सरकारच्या निवेदनात म्हटले आहे. ऑस्ट्रेलियात सेवा पुरविणाऱ्या समाजमाध्यम व्यासपीठांना या बंधनकारक संहितेनुसार त्यांच्या वापरकर्त्यांची वयोमानानुसार नोंद ठेवण्यासाठी आवश्यक ती कार्यवाही करावी लागेल.

- अशी नोंद ठेवणे समाजमाध्यम सेवा, डाटा ब्रोकर आणि अन्य मोठय़ा ऑनलाइन व्यासपीठांसाठी अनिवार्य असणार आहे. याशिवाय या सेवा पुरवठादारांना वापरकर्त्या मुलांच्या वैयक्तिक माहितीचा वापर हा मुख्यत: या मुलांच्या हितासाठीच केला जाईल, याची दक्षता घ्यावी लागणार आहे.

- फेसबुकचे उत्पादन व्यवस्थापक फ्रान्सिस ह्युगेन यांनी गेल्या महिन्यात म्हटले होते की, ज्या ज्या वेळी जनहित आणि कंपनीचे हित यापैकी एकाची निवड करण्याची वेळ येईल, त्या वेळी आम्ही कंपनीच्या हिताला प्राधान्य देऊ. त्या पार्श्वभूमीवर कायद्याच्या या मसुद्याकडे पाहिले जात आहे.

बाल विवाह से दुनियाभर में हर दिन 60 से अधिक लड़कियों और दक्षिण एशिया में एक दिन में छह लड़कियों की मौत होती है। अंतरराष्ट्रीय बालिका दिवस पर जारी एक नए विश्लेषण में दावा किया गया है कि बाल विवाह के कारण गर्भधारण और बच्चे को जन्म देने की वजह से हर साल तकरीबन 22,000 लड़कियों की मौत हो रही है। ‘सेव द चिल्ड्रन’ की इस रिपोर्ट में कहा गया है कि दक्षिण एशिया में हर साल बाल विवाह से संबंधित 2,000 मौत होती हैं। इसके बाद पूर्वी एशिया और प्रशांत क्षेत्र में 650 और लातिन अमेरिका तथा कैरेबियाई देशों में हर साल 560 मौत होती हैं।

2030 एक 1 करोड़ बच्चियों की शादी की आशंका

रिपोर्ट क अनुसार, ‘‘हालांकि, पिछले 25 वर्षों में दुनियाभर में करीब आठ करोड़ बाल विवाहों को रोका गया लेकिन कोविड-19 महामारी से पहले ही इसमें प्रगति रुक गयी और महामारी से असमानताएं और ज्यादा गहरी हुई है जिससे बाल विवाह बढ़ते हैं। स्कूलों के बंद होने, स्वास्थ्य सेवाओं पर दबाव बढ़ने तथा और परिवारों के गरीबी की ओर बढ़ने के कारण महिलाओं और लड़कियों पर लॉकडाउन के दौरान हिंसा का खतरा बढ़ा। 2030 तक एक करोड़ और बालिकाओं की शादी होने की आशंका है यानी कि और लड़कियों की मौत होने का खतरा है।’’

फैसलों में लड़कियों की भूमिका हो: एक्‍सपर्ट
‘सेव द चिल्ड्रन इंटरनेशनल’ के मुख्य कार्यकारी अधिकारी इंगर एशिंग ने कहा कि बाल विवाह लड़कियों के खिलाफ यौन और लैंगिक हिंसा का सबसे खराब और जानलेवा रूप है। हर साल लाखों लड़कियों को ऐसे पुरुषों से शादी करने के लिए मजबूर किया जाता है जो उनसे उम्र में कहीं अधिक बड़े होते हैं जिससे उनके सीखने, बचपन जीने और कई मामलों में जीवित रहने का अवसर छिन जाता है।’’ उन्होंने कहा, ‘‘बच्चे को जन्म देना किशोरियों के लिए पहले नंबर का हत्यारा है क्योंकि उनकी कम उम्र बच्चे को जन्म देने के लिए तैयार नहीं होती। बच्चियों के बच्चे पैदा करने के स्वास्थ्य खतरों को नजरअंदाज नहीं किया जा सकता। सरकार को बालिकाओं को प्राथमिकता देनी चाहिए और यह सुनिश्चित करना चाहिए कि वे बाल विवाह और समय से पूर्व बच्चे को जन्म देने से होने वाली मौतों से बची रहें। यह तभी हो सकता है जब लड़कियों को प्रभावित करने वाले फैसलों में उनकी भूमिका हो।’’
