Can a DV case be quashed at the notice stage? ⚖️
No — and here's why.
A Section 12 application under the Protection of Women from Domestic Violence Act, 2005 is not an ordinary criminal complaint. It is a civil-criminal hybrid proceeding seeking real reliefs — protection, residence, monetary relief, custody.
At the notice stage, the Magistrate has only issued process. No evidence led. No findings recorded.
Quashing at this threshold would shut the door on an aggrieved woman before she has even been heard. Courts have consistently refused to do this.
The remedy lies in contesting on merits — not in stifling the case at the doorstep.
Justice deserves a hearing. Not a shortcut.
