Indian Law states that any conflicting decisions of the civil court & criminal court aren’t binding on each other. EXCEPT for certain sentences or fines. In such cases, the civil court has a higher authority.
In a recent case, the Supreme Court set aside a criminal court conviction for a cheque bounce under Section 138 of the Negotiable Instruments (NI) Act. This was done because the civil court found that the cheque was offered as a security between the same parties.

During a Divorce proceeding, it’s usually the wife who claims Maintenance from the husband. In this groundbreaking case of role reversal, the Bombay High Court ordered the woman, working as a Bank Manager, to pay Rs 10,000 monthly maintenance to her ex-husband who’s unable to draw an income due to medical ailments.

Justice Sharmila Deshmukh observed that Section 24, Hindu marriage Act provides for the ‘spouse’ who is unable to provide for themselves, be it man or woman.

On April 24th, the Supreme Court reiterated that ‘Stridhan’ is wholly owned by a married woman and her husband has no control over it. Though he may use it in times of financial distress, he is ‘morally obligated’ to restore the same or its value to his wife.

In a recent ruling, the Supreme Court clarified the legal requirements of Hindu marriages under the Hindu Marriage Act 1955. It emphasized that the requisite religious ceremonies MUST be performed, and with adequate proof. Only then would the marriage be considered ‘solemnized’. The Marriage Registration Office cannot register such a marriage under the provisions of Section 8 of the Act.

We express our sincere congratulations to Mr Anirudh Bhalwal for successfully resolving a legal matter pending for over 3 decades.

Mr Bhalwal, appearing for the Mumbai Port Authority, received a judgement in his favour. The Court held that goods sold by Mumbai Port Authority in auction are valid as the owner failed to pay the Custom charges in time.

This matter was in Court since 1992. Finally, it has been successfully brought to completion.
