//The Supreme Court today banned the controversial Islamic practice that allows men to leave their wives immediately by stating "talaq" (divorce) three times, calling the practice "unconstitutional". The verdict vindicates the stand of the government, which had said triple talaq violates fundamental rights of women. Several Muslim women who have been divorced because of it, including on Skype and on WhatsApp, had appealed to the top court to end the practice. //

''She didn’t mind it when her parents asked her to drop out of school after Class IX and married her off at 17. Sure, her husband was unemployed and an alcoholic, who beat her up on the night of their wedding — but how out of the ordinary was that?

She was eight months pregnant when she returned to her parents’ home. The 22-year-old had tired of the abuse from her sister-in-law and husband Wasim. When the beatings continued, and living with him became a threat to her unborn child, she knew she had no choice but leave for a while.''

As a recent survey on Muslim women’s views on the Muslim Personal Law shows, women in the community are looking for a fair hearing — and a Shariah adalat in Mumbai is working to ensure their voice is heard

'' Muslim women facing triple talaq in a single sitting may soon be entitled to a hefty financial compensation. The All India Muslim Personal Law Board (AIMPLB) is mulling a decision in this regard to discourage the practice.

For the first time, the Board has decided to take up the issue during the meeting of Ulemas scheduled in Amroha later this month. "The issue of triple talaq is high on the agenda of the Amroha meeting," AIMPLB general secretary Maulana Wali Rehmani told''

'' ‘Ridiculous’, ‘unjust ‘ and ‘draconian’ – these are the words a section of Muslim scholars and activists summons to describe the practice of uttering triple talaq in a single sitting in the community.''

“At a time when most Muslim nations have abolished the practice of triple talaq, it is strange and ridiculous that India is still following the age-old system,” Naved Hamid, chairman of People’s Integration Council, told Firstpost.

''On the controversial triple talaq, for instance, one of the members insists that the Board understands that it is valid but wants to make triple talaq ‘punishable’ at one go. It is a viewpoint not shared by others, notably Ilyas, who points out that the view of one member is not the unanimous view of the Board. He says, “The Board is not a homogenous body. It has members from different schools of Islamic jurisprudence. For instance, the Ahl-e-Hadith people regard triple talaq in one sitting as only a single divorce. They believe that one month period has to lapse between each pronouncement of divorce. We, however, cannot make it punishable as we are not living in an Islamic country.”

His view is echoed by Zafarul Islam Khan who heads the All India Muslim Majlis-e-Mushawarat, an umbrella body of 12 Muslim organisations and comprising around 200 intellectuals. “If it were possible, I think triple talaq in one sitting should be punishable with lashes. It is wrong. The Quran specifies a procedure of divorce. However, we do not interfere in the working of the All India Muslim Personal Law Board. We believe they are competent to decide on such issues,” he said.''

''Most women and children do not approach a police station as soon as they are r***d. The agonising decision to report is a long-drawn process, in which family support is critical. But if the abuser is a family member, family support is hard to garner, leading to greater reluctance to report the incident. ''
