Important Housing Society Ruling by Bombay High Court

Did you know that owning a parking space or basement does NOT automatically make you a member of a housing society?

The Bombay High Court has clearly ruled that housing society membership and deemed membership under the MCS Act are available only to owners of sanctioned flats, not parking or basement areas.

This judgment is important for:
🏢 Housing society members & managing committees
🚗 Parking owners
🏠 Home buyers & residents
⚖️ Real estate and redevelopment disputes

upreme Court Comes Down Heavily on RERA

In a scathing observation, the Supreme Court has questioned the very purpose of RERA, stating that if it only helps defaulting builders, such an institution should be abolished.

What was meant to protect homebuyers is now under serious judicial scrutiny.

I am pleased to announce that two more orders obtained in favour of our clients, Daisy Irani and Ritesh Jain, have been published in the Free Press Journal. This is a significant victory for homebuyers who have been waiting years for possession of their homes.

The Maharashtra State Consumer Disputes Redressal Commission (SCDRC) has directed Omkar Realtors & Developers and ERA Realtors to:
✅ Immediately hand over possession of the flats in the Alta Monte project.
✅ Pay 8% interest on the total amount paid by the homebuyers from the date of default.
✅ Provide ₹1.25 lakh each as compensation and litigation costs.

This successful outcome was achieved through the diligent efforts of our team at The Law Suits, led by Advocate Sulaiman Bhimani and Advocate Sharon Fernandez.

This judgment is another step forward in holding developers accountable and protecting the rights of consumers. We are proud to fight for justice for homebuyers.

HOME BUYER's REMEDY UNDER CONSUMER PROTECTION ACT

Buying a home is a momentous occasion, a culmination of years of hard work and savings. But what happens when your dream turns into a nightmare, with builders failing to deliver on their promises? Many homebuyers find themselves in a limbo, waiting endlessly for possession, completion certificates, or basic amenities.

For those feeling helpless, there’s a beacon of hope in the form of a significant legal precedent: the Supreme Court’s judgment in Faqir Chand Gulati v. Uppal Agencies Pvt. Ltd. [(2008) 10 SCC 345]. This landmark case has firmly established and reinforced the rights of homebuyers as “consumers” under the Consumer Protection Act, empowering them to seek redressal against errant builders.
