(1) draft Foreign Exchange Management (Non-debt Instruments - Overseas Investment) Rules, 2021 and

The Department of Industrial Policy and Promotion (DIPP) has notified India’s Consolidated Foreign Direct Investment Policy 2020 (“FDI Policy Circular 2020”), effective from October 15, 2020. The FDI Policy 2020 is a consolidation of the various decisions taken by the Government of India in the past one year.

Notwithstanding the rescission of earlier Press Notes/Press
Releases/Clarifications/Circulars, anything done or any action taken or purported to have been done or taken under the rescinded Press Notes/Press Releases/Clarifications/Circulars prior to October 15, 2020, shall, in so far as it is not inconsistent with those Press Notes/Press Releases/Clarifications/Circulars, and applicable provisions under the FEMA and Rules/Regulations thereunder, be deemed to have been done or taken under the corresponding provisions of this circular and shall be valid and effective.

FOREIGN DIRECT INVESTMENT IN INDIA [ New Guidelines Notified in the Official Gazette]

New set of Regulations and Rules are notified in the Official Gazette on 17-10-2019 to regulate investment in India by a person resident outside India :

(1) Foreign Exchange Management (Debt Instruments) Regulations, 2019

(2) Foreign Exchange Management (Non-debt Instruments) Rules, 2019.

(3) Foreign Exchange Management (Mode of Payment and Reporting of Non-Debt Instruments) Regulations, 2019

The above guidelines supersedes the existing guidelines i.e.

(a) Foreign Exchange Management (Transfer of Issue of Security by a Person Resident outside India) Regulations, 2017

(b) Foreign Exchange Management (Acquisition and Transfer of Immovable Property in India) Regulations, 2018
