Important Point : (Law Point)
Where two persons have sued in the name of a partnership firm and if one of such persons dies during the pendency of the proceedings, it is not necessary to join the legal representatives of the deceased as a party to such proceedings, which shall continue in accordance with law.

Head Note : Code of Civil Procedure—Order 22 Rule 3, 10 , Order 30 Rule 4—Suit by partnership firm—Death of partner during pendecy of appeal—Trial Court dismissed Suit—High Court has taken the view that with the demise of one of the two partners, suit abated—Suit has been filed on behalf of partnership firm—As per Order 30 Rule 4, it is not necessary to join LR of deceased partner in case of his death and suit shall continue—Appellants themself applied to be impleaded in time—There was no reason for the High Court to decline such prayer—Held, appeal restored before High Court. (Para : 2, 6, 8, 9, 12-14)

(Background facts)
Appellant, as partner of his firm filed Civil Suit—During the pendency of that appeal, one of the partners died—His legal moved an application under Order 22 Rule 3 CPC for their substitution as legal representatives—First appeal has been dismissed holding to be abated by death of one partners.

Result : Appeal allowed. (Favour : In favour of appellants)
