जेव्हा एखाद्या व्यक्तीला त्याच्या वडिलोपार्जित मालमत्तेमध्ये त्याच्या हिस्स्याचा दावा दाखल करायचा असेल, तेव्हा त्याला किंवा तिला मालमत्तेतील हिस्स्या संदर्भात किंवा कर्ज वसुलीसाठी आणि दाव्यांच्या बाबतीत, मूल्यांकनानुसार विहित न्यायालयीन फी भरावी लागते. अनेकदा जे गरीब आहेत, त्यांना निधीच्या कमतरतेमुळे आणि असहायतेमुळे, लोकांना त्यांच्या मौल्यवान वस्तू आणि इतर मालमत्ता विकून किंवा इतरांकडून कर्ज घेऊन विहित कोर्ट फी भरण्याखेरिज इतर पर्याय नसतो. तथापि, सिव्हिल प्रोसिजर कोड मध्ये ऑर्डर ३३ अंतर्गत तरतूद आहे ज्यानुसार तुम्हाला आवश्यक कोर्ट फी न भरता दावा दाखल करता येतो. तरतुदीनुसार जर तुम्हाला गरीब व्यक्ती म्हणून घोषित केले गेले असेल तर तुम्हाला कोर्ट फी भरावी लागणार नाही आणि इतर कायदेशीर वारस किंवा तुमच्या डिफॉल्टर्सविरुद्ध खटला चालविता येतो.

When a person wants to claim his share in his or her ancestral property, he or she has to pay a prescribed court fee with respect to the share in the property or as in the case of money suits for recovery and claims, as per the valuation of the claim. Many times those who are poor, due to insufficiency of funds and due to helplessness people are often forced into paying the prescribed court fee by selling off their valuables and other properties or borrowing loans from others. However the Code of Civil Procedure has a provision under Order 33 that provides you a waiver and exemption from paying the requisite court fee. As per the provision if you are declared as a pauper person you are exempted from paying the court fee and proceed with the Suit against other legal heirs or your defaulters.

Today I got my first Pauper Petition allowed. Now my client is exempted from paying Court fees of Rs.34,000/-

The Order 33 of Code of Civil Procedure "Suit By Indigent Persons" is for those who cannot afford to pay the requisite court fees. Many people aren't aware of this beneficial provision which is statutory.

While presiding as a Retainer Lawyer for (Legal Aid) I came across many people who had no sufficient means to pay court fees and they were not aware of this benificial provision. It is the duty of every Legal Practitioner to inform them and create awareness.
