*भारतीय दंड संहिता की धारा 498A के तहत गिरफ्तारी के संबंध में सुप्रीम कोर्ट के दिशा-निर्देश*

*498A के तहत गिरफ्तारी के संबंध में सुप्रीम कोर्ट के दिशा-निर्देश*

*गिरफ्तारी से पहले की प्रक्रिया*

- *FIR दर्ज होने के बाद 2 महीने तक गिरफ्तारी नहीं*: धारा 498A के तहत शिकायत या FIR दर्ज होने के बाद 2 महीने तक कोई गिरफ्तारी नहीं की जाएगी।
- *मामले को फैमिली वेलफेयर कमिटी को भेजना*: इस 2 महीने की अवधि के दौरान, मामले को फैमिली वेलफेयर कमिटी (FWC) को भेजा जाएगा।

*फैमिली वेलफेयर कमिटी (FWC) की भूमिका*

- *FWC का गठन*: हर जिले में कम से कम एक FWC होगा, जो जिला विधिक सेवा प्राधिकरण के तहत गठित होगा।
- *FWC के सदस्य*: FWC में 3 सदस्य होंगे, जिनमें युवा मध्यस्थ, सेवानिवृत्त न्यायिक अधिकारी, सामाजिक कार्यकर्ता या विधिक पेशेवर शामिल हो सकते हैं।
- *FWC की जिम्मेदारी*: समिति पक्षों के साथ बातचीत करेगी और दोनों पक्षों के चार वरिष्ठ सदस्यों के साथ विचार-विमर्श करेगी। समिति अपनी रिपोर्ट 2 महीने के भीतर मजिस्ट्रेट को सौंपेगी।

*पुलिस और मजिस्ट्रेट की भूमिका*

- *जांच अधिकारी की जिम्मेदारी*: जांच अधिकारी को मामले की जांच करनी होगी और मजिस्ट्रेट को रिपोर्ट सौंपनी होगी।
- *मजिस्ट्रेट की जिम्मेदारी*: मजिस्ट्रेट FWC की रिपोर्ट पर विचार करने के बाद ही गिरफ्तारी का आदेश दे सकते हैं। जांच अधिकारी को गिरफ्तार करने से पहले उचित कारण दर्ज करने होंगे।

*अन्य महत्वपूर्ण बिंदु*

- *सक्षम अधिकारी द्वारा जांच*: धारा 498A के तहत अपराध की जांच केवल सक्षम अधिकारी द्वारा की जाएगी।
- *उच्च अधिकारी के अधीक्षण में कार्य*: जांच अधिकारी को उच्च अधिकारी के अधीक्षण में कार्य करना होगा ताकि वह गिरफ्तारी की शक्तियों का दुरुपयोग न करे।
- *समझौते के मामले में निपटारा*: यदि समझौता होता है, तो जिला न्यायाधीश मामले का निपटारा कर सकते हैं।

सुप्रीम कोर्ट ने कहा "पुलिस को यह अनुमति दी जाती है कि वे किसी मामले में पक्षकार को सलाह देने वाले बचाव पक्ष के वकील को सीधे तलब करें, तो इससे कानूनी पेशे की स्वायत्तता को बहुत भारी हानि पहुंचेगी और यह न्याय प्रशासन की स्वतंत्रता को भी सीधे चुनौती होगी".
