The Allahabad High Court has granted interim protection to Shankaracharya Swami Avimukteshwarananda and other accused persons, staying their arrest until the final verdict. After a hearing that lasted over an hour, a single-judge bench, presided over by Justice Jitendra Kumar Sinha, provided the relief. The case's significance was evident in the packed courtroom. The order ensures that no coercive action, including arrest, shall be taken against the Shankaracharya and co-accused until the judgment is formally pronounced.

The Supreme Court took strong objection to an NCERT Class 8 Social Science book for including a sub-chapter on corruption in the judiciary.

Within hours, NCERT withdrew the books. Of the 2.25 lakh copies printed, 2,24,962 were recalled to the warehouse, with efforts underway to retrieve the remaining 38 copies already sold. Both the Ministry of Education and NCERT issued unconditional, profuse apologies.

⚖️ हाईकोर्ट परिसर की गरिमा सर्वोपरि ⚖️

हाईकोर्ट परिसर में हुई हालिया घटना अत्यंत चिंताजनक है। कानून के रक्षक हों या कानून के जानकार—हर किसी को न्यायालय की गरिमा, मर्यादा और नियमों का पालन करना अनिवार्य है।
हिंसा, दबाव या अवैधानिक प्रवेश किसी भी स्थिति में स्वीकार्य नहीं हो सकता।

न्याय व्यवस्था की स्वतंत्रता और सम्मान बनाए रखने के लिए निष्पक्ष जांच व कड़ी कार्रवाई आवश्यक है, ताकि भविष्य में ऐसी घटनाओं की पुनरावृत्ति न हो।

• घटना हुई Kudi Bhagtasni Police Station (जोधपुर) में, जब एक वकील — Bharat Singh Rathore — ने पुलिस कर्मी से उस समय आपत्ति जताई, जब वह बिना वर्दी के बयान दर्ज करना चाहता था।
• पुलिस थाने के SHO (Hamir Singh) ने वकील को धमकाया, कहा कि “तुम वकील हो, तो तुम्हारी वकालत खत्म कर दूँगा” और उसे 151 की धाराओं में फँसाने की बात कही — वकील का कोट फाड़ा गया, और कथित रूप से धक्का-मुक्की हुई।

⚖️ वकीलों तथा न्याय व्यवस्था की प्रतिक्रिया
• यह वीडियो सोशल मीडिया पर वायरल हुआ, जिसके बाद वकीलों में भारी आक्रोश हुआ। वकील समुदाय ने थाने के बाहर धरना दिया और न्यायिक कामकाज बहिष्कार की घोषणा कर दी।
• Rajasthan High Court ने स्वतः संज्ञान लिया, आरोपी SHO और एक अन्य पुलिसकर्मी (रीडर / कॉन्स्टेबल) को सस्पेंड कर दिया गया, और मामले की जांच के आदेश दिए गए।

📌 मामला क्यों अहम है
• यह घटना पुलिस-वकील रिश्‍ते और न्यायिक वातावरण में शालीनता, प्रोफेशनलिज्म और मूल अधिकारों — जैसे कि वर्दी पहनना, सम्मान, और अभिव्यक्ति की स्वतंत्रता — के प्रति संवेदनशीलता को लेकर गठित किसी तह की ज़रूरत दर्शाती है।
• एक तरफ न्यायिक दल (वकील) की गरिमा — दूसरी तरफ नागरिकों की रक्षा की जिम्मेदारी — दोनों को बनाए रखना, और यदि पुलिस त्रुटिपूर्ण हो रही है तो उसके लिए जवाबदेही तय करना, ऐसे मामलों की अहमियत बढ़ा देती है।

Recent Judgments Allahabad HC / Lucknow Bench

1. Umed @ Ubaid Kha vs State of U.P. — False-conversion FIR खारिज, राज्य सरकार को ₹ 75,000 का जुर्माना
कोर्ट ने कहा कि FIR “vexatious / false” थी, आरोपी को तुरंत रिहा किए जाने और सरकारी कार्रवाई में जवाबदेही तय की जाए।

2. Shoaib v. State of Uttar Pradesh & Others (2025 AHC 204596-DB) — एक अकेली घटना भी “public order” भंग कर सकती है; NSA (Preventive detention) आदेश बरकरार
कोर्ट ने स्पष्ट किया कि “एक घटक” यदि सामूहिक अशांति पैदा करता है, तो preventive detention उचित हो सकती है।

3. फैसला: न्यायालय आदेश अब केवल हिंदी या अंग्रेजी में लिखे जाएँ; मिलीजुली (bilingual) उर्दू–हिंदी आदि में नहीं
यह निर्णय न्याय की पहुँच आम जनता तक आसान बनाने के उद्देश्य से; इससे lower courts को स्पष्ट निर्देश मिलेगा।

4. Mohd. Mustkeem v. State of U.P. — राज्य (सरकार) को contract terminate करने का अधिकार, subject to non-arbitrariness
Court ने कहा कि राज्य यदि license / contract देती है, तो उसे समाप्त करने का अधिकार है; पर न्याय प्रक्रिया व natural justice का ध्यान होना चाहिए।

5. फैसला: यूनियन अक्षमता (teacher-transfer)-policy को खारिज — जून 2024 के आदेश की कुछ प्रविधियाँ arbitrary और discriminatory पाईं गईं
