We are thrilled to announce that our team successfully participated in the global rounds of the FDI Moot 2024 held in Berlin, Germany.

Our team made it to the 1/8 finals, demonstrating a high level ofperformance throughout the competition. Special congratulations to Sofia Mirkhaidarova, who ranked among the top 25 advocates of the comptetion.

The team was comprised of Dilzhan Baktybekova, Sofia Mirkhaidarova, Alexey Tolstykh, Laura Makoeva, Kamilla Kinzikeeva.

This year the team was coached by Elena Murashko and Matvey Tarasov (“Rybalkin, Gortsunyan, Dyakin and Partners”), Nikita Sinitsin (“EPAM Law Offices”), Daniil Vlasenko (Curtis, Mallet-Prevost, C**t & Mosle LLP) and Dmitry Shchetinin.

Dear HSE students,

We invite everyone who is interested in international investment law to take part in the selection process for the HSE team.

The FDI Moot is scheduled to take place in Berlin, Germany from 1 to 4 November 2024 in an in-person format. The competition comprises two stages: drafting memorials for Claimant and Respondent on issues related to international investment law, and participating in oral rounds. We would be glad to welcome to our team both bachelor and master students of the HSE.

We are looking for you if:
• You are interested in developing and perfecting legal writing & oral advocacy skills;
• You are ready to devote most of the spring, summer and autumn 2024 to the intensive preparation;
• You are fluent in English;
• The knowledge of international investment law as well as prior experience with moot courts is an advantage.

1) Read the case carefully.

2) For the purposes of the written assignment, we would like to ask you to prepare a brief memorandum (word limit 1200 excluding footnotes) defending the position of either Claimant or Respondent on one of the two issues (per your choice) raised in the Procedural order No. 3, p. 73 of the PDF file).

i. Whether the Tribunal has jurisdiction ratione temporis under the BIT to hear the Claimant’s claims.

iii. Whether the Respondent has breached Article VII of the BIT:
a. Whether the Respondent’s measures amount to creeping expropriation;
b. Whether the Respondent’s measures are justified under applicable international law.

3) Submit it to the following email address [email protected] by 23.59 on 11 of April 2024.

4) Please also attach your CV (including any mooting experience, courses on investment arbitration, etc.).

5) Authors of the best memorials will be invited to the oral round consisting of a short pleading and an interview soon after the submission.

On November 5, 2023, another edition of the FDI Moot came to an end. This year more than 150 teams from the leading law schools from around the world participated in the competition. The Global Rounds of the 2023 edition were held in Lucknow, India.

During the Global Rounds, our team faced formidable competitors from various countries, including India, Singapore, and Poland.
Our team had a prolific season:
• the team reached the round of 16 in the Global Rounds; and
• two team members - Victoria Polshakova and Dilzhan Baktybekova - were ranked among the Best Advocates in the Global Rounds.

Before the Global Rounds, our team won the pre-moot organized by the FDI Moot Alumni Association and Moot Memoirs, surpassing 15 other teams from India, Argentina, Singapore, Vietnam, and China.

Our team comprised a multinational group of students (Russia, Vietnam, Kyrgyzstan) studying at the Higher School of Economics (Moscow): Arina Medvedeva, Dilzhan Baktybekova, Polina Ostranitsa, Victoria Polshakova, Pham Khanh Bao Trung, and Vladislav Chesnokov.

On 6 November 2022, another season of the FDI Moot came to an end.

This year, the HSE team included Nikita Gaevoy, Валерия Маторина, Victoria Polshakova, Anastasia Fomenko, and Dmitry Shetinin.

The team had made it to the top-30 teams, while the team’s Memorial for Respondent was ranked among the top-20 Memorials.

Many thanks to team coaches Daniil Vlasenko (Schellenberg Wittmer), Елена Мурашко (Ministry of Economic Development of the Russian Federation), Konstantin Ksenofontov (Associate Professor, HSE) for their valuable input in our participation, constant encouragement and advice.
