Every profession has certain unique mandatory demands which the professional is required to uncompromisingly fulfill. The profession of a doctor, i.e. a physician/surgeon’s profession is the MOST socially beneficial profession and the service under this profession needs to be rendered on TOP-MOST priority basis. There cannot be any other profession of more beneficial nature or carrying more urgency for the human civilization, because the life of a person is the most valuable treasure under the sun and there cannot be anything more important than to save a life.

The people who have entered into this profession are supposed to have voluntarily taken up this profession with adequate awareness, knowledge, gravity, merits and demerits of the same. So, a doctor is not expected to treat himself equally with any other professional person in any field in respect of his professional rights and responsibilities.

Therefore, the right of a doctor to refuse to treat a patient must be very very limited and cannot in all probability go beyond the situation where a doctor is physically, mentally or for lack of appropriate skill unable to treat a patient in a particular situation. Since rendering medical service needs complete mental stability, appropriate skill, availability of instruments etc. and a certain degree of physical stability, the absence thereof may lead to wrong treatment which is worse than ‘no treatment’.
