Article 21 of the Constitution of India, which guarantees the Right to Life and Personal Liberty, has consistently been interpreted by our courts to include the right to live with dignity, peace, and a healthy environment. This right is not theoretical; it extends to something as basic as the right to sleep peacefully and study without disturbance.
Noise pollution is a direct violation of this fundamental right. To address this, the Noise Pollution (Regulation and Control) Rules, 2000, framed under the Environment (Protection) Act, strictly regulate the use of loudspeakers and sound systems. The law is very clear: no loud music or public address system is permitted between 10:00 p.m. and 6:00 a.m., barring very limited and regulated exceptions. Areas around educational institutions are treated with even greater sensitivity.
Despite this clear legal position, we continue to witness loud music being played at night, causing serious inconvenience to residents. The situation is even more concerning at present, when students are appearing for examinations. Excessive noise during night hours affects concentration, mental health, and academic performance, thereby infringing upon the rights of students and other citizens.
It must be remembered that no celebration, social gathering, or personal enjoyment can override the fundamental rights of others. The Hon’ble Supreme Court has repeatedly held that freedom ends where another person’s right to life and health begins.
Noise pollution is not a minor inconvenience—it is a legal wrong and a constitutional issue. Strict enforcement of the Noise Pollution Rules is essential to uphold Article 21 and to ensure that citizens, especially students, can live and study in a peaceful environment.
Law exists not just on paper, but to be respected in practice.
