যাদের নাম Voter List থেকে বাদ গেছে, তারা কী করবেন?

অনেক সময় ভুলবশত বা ডাটা আপডেট না হওয়ার কারণে ভোটার তালিকা থেকে নাম বাদ পড়ে যায়। এই ক্ষেত্রে চিন্তার কিছু নেই—আইনে আপনার প্রতিকার আছে।

✔️ Electoral Registration Officer (ERO)-এর কাছে আবেদন করতে হবে
✔️ নির্ধারিত Form (সাধারণত Form 6) পূরণ করে জমা দিতে হবে
✔️ প্রয়োজনীয় ডকুমেন্ট (ID Proof, Address Proof) সংযুক্ত করতে হবে
✔️ শুনানির জন্য ডাকা হলে উপস্থিত থাকতে হবে

👉 যদি আবেদন গ্রহণ না হয় বা অন্যায়ভাবে নাম বাদ যায়, তাহলে আপনি Adjudication Tribunal / Appellate Authority-এর কাছে আপিল করতে পারেন

✔️ নির্দিষ্ট সময়সীমার মধ্যে Appeal করতে হবে
✔️ সমস্ত প্রমাণপত্র ও পূর্ববর্তী আবেদন সংযুক্ত করতে হবে
✔️ আইনজীবীর মাধ্যমে সঠিকভাবে বিষয়টি উপস্থাপন করা উচিত

📱 আপনার নামে থাকা SIM দিয়ে সাইবার প্রতারণা হলে পুলিশ কি আপনাকে গ্রেফতার করতে পারে?

বর্তমান সময়ে Cyber Crime তদন্তের অন্যতম গুরুত্বপূর্ণ সূত্র হচ্ছে মোবাইল নম্বর এবং সেই নম্বরের নিবন্ধিত ব্যবহারকারীর পরিচয়। অনেক সময় দেখা যায় কোনো প্রতারণা বা সাইবার অপরাধে ব্যবহৃত একটি মোবাইল নম্বর একজন ব্যক্তির নামে নিবন্ধিত রয়েছে, কিন্তু বাস্তবে সেই নম্বর ব্যবহার করছে অন্য কেউ।

এক্ষেত্রে অনেকেই প্রশ্ন করেন —
যদি SIM আমার নামে থাকে কিন্তু অপরাধ করে অন্য কেউ, তাহলে কি পুলিশ আমাকে গ্রেফতার করতে পারে?

⚖️ আইন কী বলছে?
ভারতে মোবাইল নম্বর এখন শুধু যোগাযোগের মাধ্যম নয়। এটি ব্যাংকিং, ডিজিটাল পরিচয়, OTP, এবং বিভিন্ন অনলাইন পরিষেবার সাথে যুক্ত। তাই সাইবার অপরাধ তদন্তে প্রথমেই পুলিশ খুঁজে বের করে সংশ্লিষ্ট নম্বরটি কার নামে নিবন্ধিত।

তদন্তের প্রাথমিক পর্যায়ে সাধারণত পুলিশ সেই ব্যক্তির সাথে যোগাযোগ করে যার নামে SIM নিবন্ধিত রয়েছে। ফলে অনেক সময় সেই ব্যক্তিকে থানায় ডাকা, নোটিশ দেওয়া বা জিজ্ঞাসাবাদ করা হতে পারে।

তবে শুধুমাত্র SIM আপনার নামে থাকলেই আপনাকে স্বয়ংক্রিয়ভাবে অপরাধী হিসেবে ধরা হয় না।

📜 প্রযোজ্য আইনসমূহ
সাইবার প্রতারণা সংক্রান্ত মামলায় সাধারণত নিম্নলিখিত আইন প্রযোজ্য হতে পারে:

• Information Technology Act, 2000
• Section 66C – Identity Theft
• Section 66D – Cheating by Personation using Computer Resources

এছাড়া Telecommunications Act, 2023 অনুযায়ী টেলিযোগাযোগ পরিচয় বা ডিভাইসের অপব্যবহার একটি শাস্তিযোগ্য অপরাধ।

যেমন —
• ভুয়া পরিচয়ে SIM নেওয়া
• IMEI নম্বর পরিবর্তন করা

এসব ক্ষেত্রে ৩ বছর পর্যন্ত কারাদণ্ড বা জরিমানা বা উভয়ই হতে পারে।

🧾 আদালতের গুরুত্বপূর্ণ দৃষ্টিভঙ্গি
ভারতের বিভিন্ন আদালত উল্লেখ করেছেন যে —

কেবলমাত্র কোনো SIM বা ডিজিটাল পরিচয় ব্যবহৃত হয়েছে বলেই তার নিবন্ধিত মালিক স্বয়ংক্রিয়ভাবে অপরাধী হয়ে যান না।

অপরাধ প্রমাণের জন্য প্রয়োজন —
✔ অভিযুক্তের সক্রিয় অংশগ্রহণ
✔ অথবা অপরাধ সম্পর্কে জ্ঞাত থাকা

⚠️ বাস্তবে কী সমস্যা হয়?
তদন্তের সময় পুলিশ সাধারণত প্রথমেই সেই ব্যক্তির সাথে যোগাযোগ করে যার নামে নম্বরটি নিবন্ধিত।

অনেক ক্ষেত্রে দেখা যায় —
• নিজের নামে নেওয়া SIM অন্য কাউকে ব্যবহার করতে দেওয়া হয়েছিল
• হারিয়ে যাওয়া SIM অন্য কেউ ব্যবহার করেছে
• ভুয়া KYC ব্যবহার করে SIM নেওয়া হয়েছে

এই পরিস্থিতিতে সেই ব্যক্তিকে তদন্তে সহযোগিতা করতে বলা স্বাভাবিক বিষয়।

🛡️ কীভাবে নিজেকে সুরক্ষিত রাখবেন?
নিজের আইনি সুরক্ষার জন্য কয়েকটি বিষয় সবসময় মনে রাখা জরুরি —

✔ নিজের নামে নেওয়া SIM অন্য কাউকে ব্যবহার করতে দেবেন না
✔ মোবাইল বা SIM হারিয়ে গেলে তাৎক্ষণিকভাবে ব্লক করুন
✔ নিয়মিত Sanchar Saathi Portal এ গিয়ে নিজের নামে কতগুলি SIM রয়েছে তা যাচাই করুন

ডিজিটাল যুগে একটি মোবাইল নম্বর অনেক সময় ব্যক্তির আর্থিক ও আইনি পরিচয়ের সাথে সরাসরি যুক্ত থাকে। তাই নিজের পরিচয়ের সাথে যুক্ত প্রতিটি টেলিযোগাযোগ সংযোগ নিরাপদ রাখা অত্যন্ত গুরুত্বপূর্ণ।

🏗️ আপনার জমির সামনে PWD Land-এ Illegal Construction হলে কী করবেন?

অনেক সময় দেখা যায় যে রাস্তা বা PWD (Public Works Department) জমির ওপর অবৈধ নির্মাণ করা হয়েছে, যার ফলে আপনার প্রবেশপথ (access) বন্ধ হয়ে যাচ্ছে বা চলাচলে বাধা সৃষ্টি হচ্ছে। এমন পরিস্থিতিতে উত্তেজিত না হয়ে lawful procedure অনুসরণ করাই বুদ্ধিমানের কাজ।

When an unauthorized construction is raised on public land affecting access or public pathway, certain legal remedies may be available under established municipal and constitutional procedures.
