The Supreme Court on Thursday conferred daughters with equal right to father’s property even prior to codification of Hindu personal laws and enactment of the Hindu Succession Act in 1956 and said that the law of inheritance would apply to partition of properties even if the father had died intestate before 1956.

NRI - POA

COVID has substantially hurt the confidence of many senior NRIs to travel back for documentation for transactions (especially SALE) of their native properties.
Many transactions do not see the light of the day and fail due to unavailable NRI seller for signing the papers in India. The problem can be addressed by grant of a GUARDED Power of Attorney by the NRI in favour of a person residing in India. Here, the word “Guarded” is important. Many a times, such NRI POAs have been found to be misused to hurt the interests of the NRI. A NRI may become a victim to fraud committed by his Attorney acting in conspiracy with the Buyer of the NRI’s Property. The key lies in drafting the NRI POA in such a manner that the interests remain well guarded. The scope of the powers granted to the Attorney should be limited not just to the exact acts required to be done by the Attorney but even the acts which the Attorney cannot carry out must also be specified in the POA.
