Case: Prashant Manchanda vs Union of India & Ors.
The Delhi High Court (CJ Devendra Kumar Upadhyaya and J. Tushar Rao Gedela) directed Delhi University (DU) to file an affidavit detailing steps being taken to ensure smooth and orderly conduct of the DUSU elections scheduled for September 18, 2025. The Court also directed the Delhi Police to assist DU in enforcing compliance.
The application by advocate Prashant Manchanda highlighted large-scale violations of the Delhi Prevention of Defacement of Property Act, 2007, Lyngdoh Committee recommendations, and the DUSU Code of Conduct, including unlawful rallies, processions with tractors and vehicles, pamphlet defacement, and traffic snarls. Photographs and videos were submitted as evidence.
The Court noted prima facie violations of anti-defacement guidelines and observed that excessive vehicle use, rallies, and defacement during campaigns cannot be tolerated as they disrupt public order.
A separate PIL seeking enforcement of Model Code of Conduct (MCC) Rules was disposed of, with the Court reiterating that DU bears the responsibility to ensure compliance with MCC and Lyngdoh norms, and must conduct elections peacefully.
