Guidelines for Purchasing a Land/Flat or Apartment you should go through the following steps
A. Verify the original documents of the property of Seller.
B. Collect all the Photocopies of Land/Flat or Apartment related documents and consult with an Advocate.
C. Advocate will check all the documents which are as follows:
1) Title Deed.
2) Registered Development Agreement and Registered Power of Attorney of Developer.(Applicable for Flat/ Apartment).
3) Mutation Certificate from Local Authority/Parcha from BL & LRO.
4) Conversion Certificate (for classification of land) .
5) Up to date Property Tax receipt and copy of Khazna receipt.
6) Building Completion Certificate.
7) WB HIRA Registration certificate (For Flat/apartment).
8 ) Sanctioned Plan from Zilla Parishad or Local Authority.
9) Allotment letter and Possession Letter.(Applicable for Flat/ Apartment).
10) KYC of the Seller, Buyer and Identifier.
11) 2 copies of color Passport Size photo of Each Person.
D. Advocate will check and verify the above-mentioned documents and will do the searching of ownership transfer through Local Registry Office, BL & LRO department, A.R.A Kolkata and District Registry Office.
E. After searching through various registry offices and department, if Advocate find the property free from all sorts of encumbrances charges, liabilities liens and lispendence then he will provide Non-encumbrance Certificate.
F. Then Advocate Can draft the Agreement for Sale or else he can directly draft the Deed of Conveyance for registration and raise the query from the registry office as per the discretion of the both parties.
G. The buyer will pay the Stamp duty & Registration Charges through Online with the guidance of the Advocate.
H. Then on the fixed date Seller, Buyer and identifier will go to Registry office for completing the formalities or else Advocate can apply for the Commission Registry as per the discretion of the both parties and seller will hand over all the Original documents and Keys relating to said Land/Flat or Apartment and also vacant he possession from the immediate effect and sing possession handover letter. Buyer will transfer the consideration amount through Online transaction or Demand Draft etc.
I. After completing the registry formalities IGR will provide from the Registry office mentioning the Deed no. & name of the Presentant.
J. Within 7 (Seven) Working days from the Registration, Buyer will get the Original Registered Deed of Conveyance from the Advocates Chamber.
