Flipkart, one of India’s largest e-commerce platforms, recently faced a legal dispute in the Delhi High Court. The plaintiffs sued the platform and two other parties, alleging that third parties were exploiting Flipkart’s latching-on feature to sell counterfeit products, thereby misleading the public.

മാർവലിനും ഡിസി കോമിക്സിനും "സൂപ്പർ ഹീറോ" എന്ന വ്യാപാരമുദ്രയുടെ ഉടമസ്ഥാവകാശം നഷ്ടപ്പെട്ടു.

ഏകദേശം 60 വർഷമായി "സൂപ്പർ ഹീറോ" എന്ന പദത്തിൽ ഈ രണ്ട് എതിരാളികളായ കമ്പനികളും സംയുക്തമായി പ്രത്യേക അവകാശം സ്വന്തമാക്കിയതായി നിങ്ങളിൽ ചിലർക്ക് അറിയാമായിരിക്കും. മറ്റ് കോമിക് പുസ്തകങ്ങളും സിനിമകളും അവരുടെ സൃഷ്ടികളിൽ ഈ പൊതുവായ പദപ്രയോഗം ഉപയോഗിക്കുന്നതിൽ നിന്ന് തടയാൻ ഈ ഉടമസ്ഥത അവരെ അനുവദിച്ചു.

സൂപ്പർബേബീസ് കോമിക് സീരീസിന് പേരുകേട്ട സൂപ്പർബേബീസ് ലിമിറ്റഡ് സമർപ്പിച്ച ഹർജിയെ തുടർന്നാണ് യുഎസ് പേറ്റൻ്റ് ആൻഡ് ട്രേഡ്മാർക്ക് ഓഫീസ് (യുഎസ്പിടിഒ) വ്യാപാരമുദ്ര റദ്ദാക്കാൻ തീരുമാനിച്ചത്. ഡിസിയും മാർവലും അവരുടെ പരമ്പരയായ "ദി സൂപ്പർ ബേബീസ്" പ്രമോട്ടുചെയ്യുന്നതിൽ നിന്ന് അവരെ തടയാൻ ശ്രമിച്ചതിന് ശേഷം സൂപ്പർ ബേബീസ് വ്യാപാരമുദ്രയെ വെല്ലുവിളിച്ചു.

ഈ തീരുമാനത്തിൻ്റെ ഫലമായി, "സൂപ്പർ ഹീറോ" ഇപ്പോൾ ഒരു സാധാരണ പദമായി കണക്കാക്കപ്പെടുന്നു, കൂടാതെ മാർവലിൽ നിന്നും ഡിസിയിൽ നിന്നുമുള്ള നിയമനടപടികളുടെ ഭീഷണിയില്ലാതെ ഏത് ബിസിനസ്സിനും ഇത് ഉപയോഗിക്കാൻ കഴിയും.

Marvel and DC Comics have lost their ownership of the trademark “Super Hero.”

Some of you may know that these two rival companies jointly owned exclusive right over the term “Super Hero” for nearly 60 years. This ownership allowed them to prevent other comic books and movies from using this common phrase in their works.

The US Patent and Trademark Office (USPTO) decided to cancel the trademark following a petition filed by Superbabies Limited, known for its Superbabies comic series. Super Babies challenged the trademark after DC and Marvel tried to stop them from promoting their series “The Super Babies.”

As a result of this decision, “Super Hero” is now considered a common phrase, and any business can use it without the threat of legal action from Marvel and DC.

"ആഷിഖി"യുടെ ട്രേഡ്മാർക്ക് അവകാശം കൈവശമുള്ള വിശേഷ് ഫിലിംസ് നൽകിയ ഒരു വ്യവഹാരത്തിന് മറുപടിയായി, വരാനിരിക്കുന്ന സിനിമകളിൽ "ആഷിഖി" എന്ന തലക്കെട്ട് ഉപയോഗിക്കുന്നതിൽ നിന്ന് ടി-സീരീസ് കമ്പനിയെ തടഞ്ഞുകൊണ്ട് ഡൽഹി ഹൈക്കോടതി ഇടക്കാല ഉത്തരവ് പുറപ്പെടുവിച്ചു.

The Delhi High Court has issued an interim injunction preventing T-Series from using the title “Aashiqui” in any upcoming films, in response to a lawsuit filed by Vishesh Films, which holds the trademark rights to “Aashiqui”. Our intern, Ronsiya Roy, is covering this development in her article.
