The trademark used by the appellant, which is a portrait of ‘Hanuman’, in a flying pose, carrying the sanjeevi hills in his hands, is deceptively similar to that of the registered trademark of the respondent. The learned Judge also held that the trademark used by the appellant could deceive the purchasers of edible oil, as they would be misled into thinking that the goods sold by the appellant had been manufactured and marketed by the respondent
