बलात्कार का अपराध—दोष-सिद्धि के विरुद्ध अपील—पीड़िता एक विवाहित महिला है—यद्यपि बलात्कार मामलों में चिकित्सकीय सबूत दोष-सिद्धि के लिए अनिवार्य नहीं हैं लेकिन इसकी अनुपस्थिति या विसंगति, जब अभियोजन के कथन में गंभीर कमियों के साथ जुड़ जाए, तो युक्तिसंगत संदेह पैदा करती है—वर्तमान मामले में, पीड़िता के बिना सूचना अपना ससुराल छोड़ने के संबंध में उसके ससुराल पक्ष के किसी भी सदस्य का साक्ष्य संकलित किए जाने के अभाव और चिकित्सा परीक्षक द्वारा घटना के पंद्रह दिन बाद की गई जाँच में जबरन यौन संबंध के कोई सबूत न मिलने के कारण अभियोजन पक्ष का मामला और कमजोर हो गया—अतः, अभियुक्त को "संदेह का लाभ" देते हुए बरी किया जाता है।

महत्वपूर्ण सिद्धांत:
(1) पीड़िता की गवाही अकेले दोष-सिद्धि के लिए पर्याप्त हो सकती है परंतु उसमें विसंगतियाँ होने पर अभियुक्त के पक्ष में निर्णय लिया जा सकता है।
(2) चिकित्सकीय सबूत का अभाव + अभियोजन की कहानी में कमियाँ = युक्तिसंगत संदेह का आधार

राष्ट्रीय विधिक सेवा प्राधिकरण (नालसा) द्वारा सुप्रीम कोर्ट के माननीय न्यायमूर्ति भूषण रामकृष्ण गवई और नालसा के कार्यकारी अध्यक्ष के मार्गदर्शन में भारत में 2025 की प्रथम राष्ट्रीय लोक अदालत 08 मार्च 2025 को आयोजित की जाएगी।

लोक अदालत क्या है?
लोक अदालत भारत की न्याय व्यवस्था का एक प्रमुख हिस्सा है, जिसमें विवादों को जल्दी, किफायती और सौहार्दपूर्ण तरीके से हल करने का एक मंच प्रदान किया जाता है। लोक अदालतों द्वारा किए गए निर्णय अंतिम, बाध्यकारी और कानून द्वारा मान्य होते हैं।

मुख्य विशेषताएँ:
✔ समान और सुलभ न्याय को बढ़ावा देना
✔ अदालतों के भार को कम करना
✔ प्री-लिटिगेशन और लंबित मामलों का समाधान, जिसमें शामिल हैं:
i. आपराधिक कंपाउंडेबल मामले

18 Exam Pattern 2023: Paper Pattern, Marking
Scheme
AIBE XVIII (18) Exam Pattern 2023
The Bar Council of India has released the AIBE 18 exam pattern 2023 on its website
along with the notification. The AIBE 18 exam 2023 shall be held in offline mode. You
must note that no changes have been made in the AIBE 18 exam pattern 2023 yet.
Hence, the paper pattern remains the same as the previous year. You should also take
note that the AIBE exam shall not be an open-book exam. The candidates will, however,
be free to carry Bare Acts without short notes. Candidates who are going to apply online
for AIBE 18 exam should check here the marking scheme, medium of exam, paper
pattern and more.
AIBE XVIII Exam Pattern 2023
The AIBE XVIII exam shall be an offline exam. Candidates appearing for the exam will
have to attempt a total of 100 questions in 3 hour 30 minutes. All the questions shall be
multiple-choice questions. The detailed exam pattern of AIBE 18 has been given below:

Is AIBE 18 exam 2023 open-book?
No, AIBE 18 exam will not be an open-book exam. The candidates will only be allowed
to carry Bare Acts without short notes inside the exam hall. This means that they AIBE
exam aspirants will only have to carry books, notepads, textual material with them.
