INTER CASTE COUPLES CAN CHOOSE THEIR CHILDREN'S DESIRED CASTE:
Inter-caste couples in India can choose their children's caste certificate, selecting either the father's or the mother's caste, based on Supreme Court rulings. Courts have ruled that children are entitled to the caste of either parent, allowing access to reservation and constitutional benefits, especially if the mother belongs to a Scheduled Caste (SC) or Scheduled Tribe (ST)
The Supreme Court has ruled that denying a child a caste certificate based solely on the father's caste is discriminatory. Children can claim the caste of their mother for benefits if she belongs to an SC/ST category, regardless of the father's higher-caste status.
Parents often have the flexibility to choose which caste identity is officially adopted for their child's socio-economic benefits. This legal standing applies to both caste recognition and social benefits in various parts of India.
