Arnesh Kumar v. State of Bihar (2014) हा सुप्रीम कोर्टाचा महत्त्वाचा निर्णय असून तो अनावश्यक व बेकायदेशीर अटक होण्यापासून सामान्य नागरिकांचे संरक्षण करतो, विशेषतः ७ वर्षांपर्यंत शिक्षा असलेल्या गुन्ह्यांमध्ये.
🔹 Key Legal Points / महत्त्वाचे कायदेशीर मुद्दे:
✅ Police cannot arrest automatically just because an FIR is registered.
✅ FIR नोंद झाली म्हणून लगेच अटक करता येत नाही.
✅ Police must record written reasons for arrest.
✅ अटक का आवश्यक आहे याची लेखी कारणे पोलिसांनी नमूद करणे बंधनकारक आहे.
✅ Notice of Appearance (Sec. 41A / BNSS equivalent) should be issued instead of arrest in appropriate cases.
✅ अनेक प्रकरणांमध्ये अटक न करता नोटीस देणे बंधनकारक आहे.
✅ Magistrate must verify police compliance before granting custody.
✅ पोलीसांनी नियम पाळले आहेत का हे दंडाधिकारी तपासतात.
