Rights of an Arrested Person . . . .

1)Right to know the grounds of Arrest.

2)Right to be produced before the Magistrate without unnecessary delay and right of not being detained for more than 24 hours without judicial scrutiny.

3) Rights to be released on Bail.

4) Rights to a fair trial.

5) Right to consult a lawyer.

6) Right to free Legal Aid.

7) Right to keep silence.

"Doctrine of Double Jeopardy"

Constitution of India Article 20(2) says that no person shall be prosecuted and punished for the same offence more than once.

This is called Doctrine of Double Jeopardy.

The objective of this article is to avoid unnecessary harassment, which would be caused for consecutive and improper criminal proceedings.

The concept is " where the person has committed only one crime then he should be punished for that one crime only" .

The Latin maxim Nemo Debet Bis Vexar is related to this.

This means that no man shall be put twice in menace for the same offence.

Fundamental Rights Part III of the Constitution of India "Articles 12 to Article 35".

Fundamental rights are different from other ordinary legal rights in the manner or way in which they are enforced.

Some of the fundamental rights are available For all citizens while the rest are for both citizens and non-citizens.

Fundamental rights are not always considered as absolute rights. They have subject to certain reasonable restrictions, which means they are subject to the few conditions like security, public morality and decency and friendly relations with foreign countries or state .

If any legal rights are violated, the aggrieved person cannot directly approach the Supreme Court bypassing the lower courts. He or she should first approach the lower courts for remedy. People can approach the SC directly in case of violation of fundamental rights.

Fundamental rights can be amended by the Parliament by a constitutional amendment but only if the amendment does not alter the basic structure of the Constitution.

Fundamental rights can be suspended during a national emergency except the rights guaranteed under Articles 20 and 21 .
