As proof of date and place of birth, only the birth certificate will be valid now 🌀

Question: Honorable, is it true that the Government of India has made changes to the rules regarding the date of birth certificate?

Is it also true that for applicants born on or after October 1, 2023, only the birth certificate will be considered as the sole proof of date and place of birth? Please clarify the legal position on this matter.

Answer: The Government of India has enacted the Birth and Death Registration (Amendment) Act, 2023, which came into effect on October 1, 2023.

According to this amendment, for individuals born on or after October 1, 2023, the birth certificate will be the only valid proof of date and place of birth.

This rule will also apply to government documents such as passport applications, Aadhaar cards, voter IDs, driving licenses, admissions to educational institutions, marriage registrations, and appointments to government jobs.

This means that for passport applicants born on or after October 1, 2023, the birth certificate will be considered the sole valid proof of date and place of birth. Other documents like Aadhaar card, voter ID, or educational certificates will not be accepted as proof of date of birth.

The purpose of this new rule is to simplify the process of government documentation and provide citizens with convenience by using a single proof document to avail various services.

The sending of a notice to the accused through WhatsApp under Section 41-A of the Criminal Procedure Code (CrPC) (Section 35 of the BNSS Act) is contrary to legal provisions. Sending a notice via WhatsApp or other electronic mediums under Section 41-A of the CrPC is an invalid or irrelevant method, as it does not adhere to the requirements for serving notices as laid down by the CrPC and BNSS Act, 2023. Such methods bypass the statutory provisions and do not comply with the prescribed protocols for notice service. The police are directed to strictly follow the established protocols for notice service. High courts and Chief Secretaries of states/union territories are instructed to ensure compliance with these guidelines within three weeks, except for guideline (e).
