In the matter of Suresh Madan v. Manvendra Singh, the final order which was delivered yesterday, i.e., 07.08.2022, the Honโ€™ble Madhya Pradesh High Court held that a second application under Order VII Rule 11 of the Civil Procedure Code, 1908 is maintainable and not hit by the principles of res judicata.

Order VII, Rule 11 provides for the grounds on which plaint may be rejected by the Court. In the present matter, the Court further held that the provisions of Order VII Rule 11 are not exhaustive and the court has an inherent power to see that frivolous or vexatious litigation is not allowed to consume the time of the Court. When the cause of action is not disclosed in the plaint, the plaint ought to have been rejected.

In a healthy democracy, the rights of people should always be balanced. Oneโ€™s right should not unreasonably affect the otherโ€™s rights.

The Madhya Pradesh High Court recently passed an order in a PIL wherein the Petitioner โ€“ Advocate Union for Democracy and Social Justice โ€“ had sought publication of the answer books of the civil judge examinations on the website of M.P. High Court. The prayer was sought on the premises of Section 3 of the Right to Information Act, 2005 which categorically gives all citizens the right to information from the government authorities.

The Petitioner through the PIL had sought more transparency and accountability, and pleaded that the publication of the answer sheets would also be โ€œacademically enriching for prospective candidatesโ€. The counsel for the Respondent, however, argued that such publication would be against public interest and would be violative of the right to privacy of the candidate who wrote the answers. Further, the Respondent's counsel also argued that Section 8(1)(j) provides for non-disclosure of personal information when the same does not concern the public interest.

The Honโ€™ble Court dismissed the Petition, and held that the publication of the answer sheets on websites would be counterproductive because of the difficulties that might arise. Further, making available the answer sheets in the public domain would not only violate the right to privacy of the candidates but would also be against the public interest.
