Bombay High Court: Unwarranted handcuffing of a lawyer and a retired soldier; State directed to pay ₹50,000 each as compensation

The Nagpur Bench of the Bombay High Court, in a significant judgment, clarified that handcuffing a person without valid justification, stripping them, and parading them in public is not only illegal but also a serious violation of their dignity and fundamental rights. In this case, the Court held the police action to be completely unjustified and ordered compensation for the victims.

Facts of the Case:
• The police detained the petitioners in a non-cognizable matter
• They were handcuffed and taken in a public bus
• They were stripped in the lock-up

बॉम्बे हाई कोर्ट की नागपुर बेंच ने एक महत्वपूर्ण फैसले में स्पष्ट किया कि किसी व्यक्ति को बिना उचित कारण हथकड़ी लगाना, कपड़े उतरवाना और सार्वजनिक रूप से घुमाना न केवल अवैध है, बल्कि यह उसके सम्मान और मौलिक अधिकारों का गंभीर उल्लंघन है। इस मामले में पुलिस की कार्यवाही को न्यायालय ने पूरी तरह गलत ठहराया और पीड़ितों को मुआवजा देने का आदेश दिया।
