The Indian Judiciary is an independent organ of the government responsible for interpreting laws, protecting the Constitution, and delivering justice. The judiciary in India follows a single integrated judicial system, with the Supreme Court at the top, followed by High Courts, District Courts, and Subordinate Courts.

1. Supreme Court of India
Supreme Court of India is the highest court in the country and the final authority in the judicial system.

తెలంగాణ హైకోర్టు చారిత్రాత్మకమైన తీర్పునిచ్చింది.

పోలీసులు ఇకపైన కొరడా జరిపించడానికి ఎటువంటి ఆస్కారం లేదని చెప్పి కింద మార్గదర్శకాలను జారీ చేసింది.

పోలీస్ అధికారులు పాటించవలసిన మార్గదర్శకాలు..

సోషల్ మీడియా పోస్టులు, రాజకీయ ప్రసంగాలు, లేదా వ్యక్తిగత పరువు నష్టం (Defamation) వంటి అంశాలపై FIR నమోదు చేయుటకు సంబంధించి క్రింది మార్గదర్శకాలు ఖచ్చితంగా పాటించవలెను:

1. లొకస్ స్టాండీ పరిశీలన
పరువు నష్టం వంటి ఫిర్యాదుల విషయంలో FIR నమోదు చేయకముందు, ఫిర్యాదు చేసిన వ్యక్తి “అగ్రీవ్డ్ పర్సన్” (నేరుగా నష్టం పొందిన వ్యక్తి) అవుతాడో లేదో పోలీసులు నిర్ధారించాలి. సంబంధం లేని మూడో వ్యక్తుల ఫిర్యాదులు నిలబెట్టుకోలేవు. కానీ, కాగ్నిజబుల్ నేరం (గుర్తింపు పొందిన నేరం) అయితే మాత్రం మినహాయింపు ఉంటుంది.

2. ప్రాథమిక విచారణ
ఫిర్యాదు కాగ్నిజబుల్ నేరాన్ని సూచిస్తే, వెంటనే FIR నమోదు చేయకుండా ముందుగా ఒక ప్రాథమిక విచారణ చేసి, ఆ నేరానికి సంబంధించిన చట్టపరమైన అవసరమైన అంశాలు (ingredients) ఉన్నాయో లేదో నిర్ధారించాలి.

3. ప్రసంగం/మీడియా పోస్టులపై కఠిన ప్రమాణం
శత్రుత్వాన్ని ప్రోత్సహించడం, ఉద్దేశపూర్వక అవమానం, ప్రజా శాంతిభంగం, లేదా తిరుగుబాటు (sedition) ఆరోపణలపై FIR నమోదు చేయాలంటే, హింసకు ప్రేరేపించే లేదా ద్వేషం, శాంతిభంగాన్ని కలిగించే పదార్థం ఉన్నదనే ప్రాథమిక ఆధారాలు తప్పనిసరిగా ఉండాలి. (Kedar Nath Singh v. State of Bihar, 1962 మరియు Shreya Singhal v. Union of India, 2015 తీర్పులను అనుసరించాలి).

4. రాజకీయ ప్రసంగ రక్షణ కఠినమైనా, విమర్శాత్మకమైనా, లేదా అవమానకరమైనా రాజకీయ ప్రసంగం మాత్రమే ఉంటే FIR నమోదు చేయరాదు. హింసకు ప్రేరేపిస్తే లేదా ప్రజా శాంతికి తక్షణ ముప్పు కలిగిస్తే తప్ప క్రిమినల్ చట్టం వర్తించదు. రాజ్యాంగంలోని ఆర్టికల్ 19(1)(a) క్రింద ఉన్న స్వేచ్ఛా భావ ప్రకటన హక్కు కాపాడబడాలి.

5. పరువు నష్టం నాన్-కాగ్నిజబుల్ నేరం
Defamation (పరువు నష్టం) నేరం నాన్-కాగ్నిజబుల్ కిందకి వస్తుంది. కాబట్టి పోలీసులు నేరుగా FIR నమోదు చేయరాదు. ఫిర్యాదుదారు సంబంధిత మేజిస్ట్రేట్‌ వద్ద ఫిర్యాదు చేయాలి. మేజిస్ట్రేట్‌ సెక్షన్ 174(2), BNSS ప్రకారం ఆదేశం ఇచ్చిన తర్వాతే పోలీసులు చర్యలు చేపట్టాలి.

6. అరెస్ట్ మార్గదర్శకాలు
అన్ని కేసుల్లోనూ పోలీసులు Arnesh Kumar v. State of Bihar (2014) తీర్పులో పేర్కొన్న మార్గదర్శకాలను ఖచ్చితంగా పాటించాలి. యాంత్రికంగా అరెస్టులు చేయరాదు. క్రిమినల్ ప్రక్రియలో సామాన్య ప్రమాణం (proportionality) పాటించాలి.

7. సున్నితమైన కేసుల్లో లీగల్ అభిప్రాయం
రాజకీయ ప్రసంగం/సోషల్ మీడియా పోస్టుల వంటి సున్నితమైన కేసుల్లో FIR నమోదు చేయకముందు పబ్లిక్ ప్రాసిక్యూటర్‌ అభిప్రాయం తప్పనిసరిగా తీసుకోవాలి.

8. అసత్య/ప్రేరేపిత ఫిర్యాదులు ఫిర్యాదు అసత్యమైనది, దురుద్దేశపూర్వకమైనది, లేదా రాజకీయ ప్రేరేపితమైనది అని తేలితే, పోలీసులు BNSS సెక్షన్ 176(1) ప్రకారం “తగిన ఆధారాలు లేవు” అని పేర్కొని మూసివేయాలి.
