Landmark Update: Registered trademark ≠ automatic injunction!
We’re pleased to share that the Delhi High Court recently restored the right of Nutrivative Foods Private Limited to use its registered mark “Nourish You”, setting aside an interim injunction that restrained its use.

📌 What happened?

Nutrivative Foods, holding a valid registration for “Nourish You” in Class 35 (retail/marketing of plant-based foods), argued the prior injunction denied its statutory right under the Trade Marks Act, 1999.

The respondent raised earlier use of the mark “Nourish” (since 2007) in related food-classes, but the Court found the Commercial Court’s assumption (that use was since 2007 in all goods) to be an “omnibus exaggeration.”

The High Court held that when both parties hold registrations for similar marks, each is entitled to use their own mark — one registration does not automatically bar another from use.
