Domestic violence is sadly a reality in Indian society, a truism.
In the Indian patriarchal setup, it became an acceptable
practice to abuse women. There may be many reasons for the
occurrence of domestic violence. From a feminist standpoint, it
could be said that the occurrence of domestic violence against
women arises out of the patriarchal setup, the stereotyping of
gender roles and the distribution of power, real or perceived, in
society. Following such ideology, men are believed to be
stronger than women and more powerful.

A marriage which has already been solemnised can be registered either under the Hindu Marriage Act, 1955 or under the Special Marriage Act, 1954. The Hindu Marriage Act is applicable in cases where both the husband and the wife are Hindus, Buddhists, Jains or Sikhs, or in cases where they have converted into any of these religions. In case either the husband or the wife or both are not Hindus, Buddhists, Jains or Sikhs, the marriage is registered under the Special Marriage Act, 1954. Further, the marriage can be solemnised between any two persons under the provisions of the Special Marriage Act, 1954.

SECTION 9 OF THE HINDU MARRIAGE ACT
Restitution of conjugal rights—When either the husband or the wife has, without reasonable excuse, withdrawn from the society of the other, the aggrieved party may apply, by petition to the District Court, for restitution of conjugal rights and the court, on being satisfied of the truth of the statements made in such petition and that there is no legal ground why the application should not be granted, may decree restitution of conjugal rights accordingly.
Explanation—Where a question arises whether there has been reasonable excuse for withdrawal from the society, the burden of proving reasonable excuse shall be on the person who has withdrawn from the society.
