In a Nutshell for Easy Understanding :-

The Uniform Civil Code (UCC), Assam, 2026 is a law that creates a common set of rules for marriage, divorce, inheritance, wills, and live-in relationships for all residents of Assam, irrespective of religion.

Part I – Preliminary Provisions

The law is called the Uniform Civil Code, Assam, 2026.
It applies throughout Assam and also to Assam residents living outside the State.
Scheduled Tribes notified under Article 342 of the Constitution are exempt from this Code.
Polygamy is prohibited. A person cannot marry again while a previous marriage is legally subsisting.
"Resident" includes permanent residents of Assam, government employees serving in Assam, persons residing in Assam for at least one year, and beneficiaries of government schemes.

Marriage

Conditions for a Valid Marriage
A valid marriage requires:
Minimum legal age (21 years for males and 18 years for females).
Both parties must be unmarried.
Free consent and sound mind.
No prohibited blood relationship.
Compliance with existing laws.
Marriage may be performed according to any religious ceremony such as Hindu, Muslim, Christian, Sikh, Ahom, or other customary ceremonies.

Marriage Registration

Registration of every marriage is compulsory, irrespective of religion.
Existing marriages must also be registered within the prescribed period.
Divorce decrees must be submitted to the Sub-Registrar within 60 days after becoming final.
Restitution of Conjugal Rights and Judicial Separation
A spouse abandoned without reasonable cause may seek restitution of conjugal rights from the Court.
Either spouse may seek judicial separation on grounds available for divorce.
Void Marriages
A marriage is void if:
Either party already has a spouse.
Either party is underage.
Parties fall within prohibited relationships.
Other legal requirements are violated.

Divorce
Divorce may be granted on the following grounds:

Adultery
Cruelty

Desertion for two years or more
Religious conversion
Unsoundness of mind
Incurable mental illness
Leprosy or venereal disease
Renunciation of worldly life
Not heard alive for seven years
Additional grounds available to a wife:
Husband convicted of r**e, so**my, or similar offences.
Husband had multiple wives before commencement of the Code.
Mutual Consent Divorce
Husband and wife must have lived separately for at least one year.
The second motion must be filed between six and eighteen months after filing the petition.
Courts may relax the one-year requirement in exceptional cases.
Maintenance
Maintenance includes food, clothing, residence, education, medical expenses, and special needs.
Family Courts will deal with disputes under the Code.

Part II – Succession and Wills

If a person dies without a will, property will be distributed according to the inheritance rules of the Code.
Any person above 18 years of age and of sound mind may make a will.
A codicil is a document that modifies or supplements a will.
Property may generally be bequeathed according to the wishes of the testator.
Impossible or unlawful conditions attached to a bequest are void.
A residuary legatee receives the remaining property after other bequests are satisfied.
Repeated gifts of the same property to the same person are counted only once.
Probate and Administration
Executors must obtain probate from the District Judge for legal recognition of a will.
Where no executor exists, the Court may appoint an administrator.
If estate assets are insufficient, beneficiaries may have to refund legacies proportionately.

Part III – Live-in Relationships

A live-in relationship means a man and a woman living together in a shared household and presenting themselves as a couple without being legally married.
Prohibited Live-in Relationships
A live-in relationship is not permitted if:
Either partner has a living spouse.
Either partner is below 21 years of age.
Partners are within prohibited relationships.

Registration

Registration of live-in relationships is compulsory.
Partners must submit a statement to the Sub-Registrar.
The Sub-Registrar may conduct an inquiry and decide the application within 30 days.
Registration does not create the legal status of marriage.
Partners Below 21 Years
If either partner is below 21 years:
Parents or guardians must be informed.
Information will also be sent to the local police station.

Termination

Either partner may terminate the relationship by filing a statement before the Sub-Registrar.
If only one partner terminates the relationship, the other partner must be informed.
Punishment
Failure to register a live-in relationship within one month may result in:
Imprisonment up to 3 months, or
Fine up to ₹10,000, or both.
False information in registration may result in:
Imprisonment up to 3 months, or
Fine up to ₹25,000, or both.
Failure to register despite notice may result in:
Imprisonment up to 6 months, or
Fine up to ₹25,000, or both.

Maintenance

A woman deserted by her live-in partner may claim maintenance through the Court.

Part IV – Miscellaneous

Personal laws and customs inconsistent with this Code cease to apply in matters covered by the Code.
Cases already pending under previous laws will continue under those laws.

About the language for recording statement :

Under the criminal law ( section 183 of BNSS) a magistrate records the statement or confession in the language spoken by the individual.
If the witess or accused speaks a regional dialect like Assamese, Bengali or Hindi , the statement must be taken down in that exact language.
If it is recorded in a language the individual does not understand, it must be interpreted to them in their mother tongue before they asked to sign it.
The honourable Supreme Court has stressed that evidence and statements are best appreciated when recorded in the exact vernacular language of witness.
Under section 25(1) , 26(1) of Protection of Children from Sexual Offences Act, 2012, the statement shall be or should recorded verbatim as spoken by the child.
The statement are typically recorded in the vernacular (native) language of the person speaking or in the official language of the court or authority.
If the language spoken is different, the authority will use a translator or interpreter and then translate the record back to be speaker so they can confirm its accuracy.

Few line about Special Juvenile Police Unit

Special Juvenile Police Units are designated units in every district mandated by Juvenile Justice ( care and protection of children) Act 2015 to handle the children who are in conflict with law, in need of care, focusing on protection rather then punishment.

These units emphasis child friendly procedure as wearing plain cloths, avoiding lock ups, providing a supportive environment , to foster positive police child relations and ensure a right with the best perspective or approach .

The Sopecial Juvenile Police Units are structured with an Officer not below the rank of superintendent of police as Head of the unit. And he is accompanied with child welfare police officers and two social workers.

The key function of this unit is to look after the safety and protection of children, handles reporting, investigating of crimes against children and manages cases involving missing children. They also should ensure that child are never kept in lock up and produced before the JJ Board or Child welfare commitee within 24 hrs. They work collaboration with District Child Protection Unit , NGOs, District Legal Service Authority to provide legal aid and protection.

Special Juvenile Police Unit work as watch-dog for providing legal protection against all kinds of cruelty, abuse and exploitation of children and report instances of non-compliance for further legal action.

Legal Framework Governing Adjournments...............................

Under the Supreme Court Rules, 2025 (the “Supreme Court Rules”), two provisions in particular warrant attention for the purposes of the present matter: Order XX, Rule 2, and Order ###, Part A, Rule 3.These provisions respectively govern (i) the procedure for seeking adjournment, and (ii) the consequences where adjournment is sought without sufficient cause.. Order XX, Rule 2 of the Supreme Court Rules expressly provides that:

Adjournment of cases of all kinds for hearing shall only be granted on proper application filed by Advocate-on-Record except where it is sought by a party conducting his case in person.

Thus, the procedural mechanism for seeking adjournment requires that the application be moved through the learned Advocate-on-Record (“AoR”) appointed in the matter. This requirement reflects the central role of the AoR in the conduct of proceedings before this Court and the attendant responsibility to ensure that matters fixed for hearing are effectively prosecuted without disruption caused by the(naeem) absence, convenience, or scheduling preferences of individual counsel. The framework is put in place to ensure that proceedings before this Court are not stalled on grounds unconnected with any legal or unavoidable impediment.

Further, Order ###, Part A, Rule 3 of the Supreme Court Rules provides:

Where it appears to the Court that an Advocate or a party seeks adjournment for which sufficient cause is not shown, the Court may impose compensatory costs on the Advocate or, as the case may be, the party seeking such adjournment. Costs may also be imposed on a party who files false or vexatious appeal or other proceedings and thereby wastes the time of the Court.

The import of the above provision is clear. It is intended to discourage the routine or unjustified seeking of adjournments by (naeem)attaching consequences to such conduct. Requests for adjournment that are not founded upon sufficient cause are not to be treated as routine procedural indulgences, but as matters engaging disciplinary and penal consequences, so as to preserve procedural discipline and respect for judicial time.

In furtherance of the aforesaid provisions of the Supreme Court Rules, the Supreme Court of Pakistan issues procedural directions for learned counsel through its weekly public cause list, which expressly provides:

i) No application for adjournment through fax/email will be placed before the Court. If any counsel is unable to appear for any reason, the Advocateon-Record will be required to argue the case.

(ii) No adjournment on any ground will be granted.

These directions serve to reiterate that the unavailability or inability of counsel to appear does not constitute sufficient cause for adjournment, as the learned AoR is expected to argue the matter in such circumstances. They further clarify that no adjournment shall be granted to counsel on any ground whatsoever, as, in consonance with the Order XX, Rule 2 of the (naeem)Supreme Court Rules, the correct mechanism of filing for adjournment is a written application filed by the learned AoR personally.

Taken together, the above provisions and directions leave no ambiguity as to the legal position governing adjournments before this Court. The procedural framework mandates that adjournments may only be sought through a properly instituted application by the learned AoR, and even then only upon demonstration of sufficient cause. Simultaneously, it is abundantly clear that the unavailability or convenience of individual counsel does not, in itself, constitute a valid ground for adjournment, as the responsibility to proceed with the matter rests with the AoR. The overall (naeem)scheme is, therefore, reflective of the factthat adjournments remain strictly exceptional.

Notwithstanding the legal and institutional position set out above, this Court continues to exercise its discretion where genuine exigencies are demonstrated and sufficient cause is shown in accordance with the applicable Supreme Court Rules, by duly considering and, where warranted, allowing requests for adjournment in the interest of fairness and due process. This, however, cannot be construed as diluting the strictness of the governing framework, nor as justifying the routine invocation of adjournments as a matter of convenience.

Statistics Regarding Adjournments:...........................
Despite the aforementioned legal framework, repeated reminders, and the settled position that adjournments are granted only upon sufficient cause, the record before the Court demonstrates that these principles are not being followed in practice. We (naeem)note, with immense disappointment, that the mandate governing adjournments is being increasingly disregarded by counsel.

Official data generated by the IT-Directorate of this Court reveals a highly concerning pattern. Between January 2026 and March 2026, a totalof 653 adjournments were sought by advocates.

More concerning is the fact that an overwhelming majority of adjournments are sought despite the Court being assembled and matters being otherwise ready for hearing, thereby rendering substantial judicial time unproductive. This data clearly reflects a pattern of casual, convenience-based requests made in disregard of binding rules and express cause-list warnings, (naeem)which is not expected from advocates performing their duties at the apex level of our judicial system.

Practical Impact of Adjournments:...................

We state in the clearest possible terms that such a practice is wholly unacceptable. Lawyers, not just before this Court but across Pakistan, must realise the direct correlation between adjournments and the burden they place upon the public exchequer.

The justice system of the country is sustained entirely through public funds, allocated to the Courts solely for the administration of effective and timely justice. Accordingly, each matter fixed for hearing necessarily sets in motion the expenditure of public resources. Judicial time, court staff, courtroom infrastructure, security arrangements, and administrative support are all engaged the moment a cause list is issued and a matter is placed for hearing. When (naeem)such a matter is then not taken on account of an avoidable adjournment, that entire institutional deployment stands expended without the discharge of its adjudicatory function in that cause, and in essence, is wasted.

Again, it must be remembered that the consequence of this wastage is ultimately borne by the public purse. It is neither theoretical nor capable of re-adjustment within the system. In fact, in the most practical terms, judicial time and institutional resources, once expended, are irretrievable, as they cannot be reclaimed or diverted to other pending matters already competing for space within a finite judicial calendar.

Moreover, unnecessary adjournments strike at the very heart of the access to justice. For litigants, particularly those of limited means, repeated adjournments translate into increased expense and, in effect, a denial of timely justice. This, in turn, erodes public confidence in the judicial system and runs contrary to the institutional efforts of this Court to ensure expeditious disposal of cases. It thus bears emphasis that the right to fair trial and due process under Article 10-A of the Constitution, as well as the larger constitutional (naeem)promise of effective judicial remedies, cannot coexist with a culture of routine adjournments sought merely for convenience.

While this Court has shown and will continue to show indulgencewhere genuine exigencies are shown, such indulgence cannot be mistaken for acquiescence. Adjournments remain exceptions granted at the discretion of the Court, not entitlements. The persistent misuse of requestsfor adjournment, despite clear rules and warnings, is equivalent to impeding the duty of this Court to fairly and effectively dispense justice, and shall be treated accordingly.

Accordingly, the Bar is once again put on clear notice that adjournments sought without strict compliance with the legal framework and without demonstrable sufficient cause shall invite appropriate consequences, including imposition of compensatory costs in terms of the Supreme Court Rules.

⚖️ Delhi High Court decides important principles on cancellation of POCSO cases (Quash)

The Delhi High Court has clarified in an important decision that under which circumstances cases registered under the POCSO Act can be cancelled — especially in cases where relationship has turned into consensual and subsequent marriage or mutual agreement.

📌 What was the case?
Many such cases came before the court, where—
• The relationship between boy and girl was consensus
• Later both got married or started living together
• The victim (victim) denied any kind of exploitation or forcefulness

In such cases the court has decided guidelines/principals to decide whether the FIR should be continued or cancelled.

⚖️ Principles decided by the High Court (Principles):

🔹 1. Actual exploitation is necessary
If the record makes it clear that the connection was consensus and there was no pressure or exploitation, it is not fair to continue the case.

🔹 2. The victim's clear statement is important
If the victim himself says that—
👉 he got no harm
👉 Relationship was by his will
So the court will take this aspect seriously.

🔹 3. Protection from 'Revictimisation'
If the trial causes more mental/social harm to the victim, the case may be cancelled.

🔹 4. Marriage or permanent relationship an important factor
If both parties are now married or in a permanent relationship, the court also considers this social reality.

🔹 5. The purpose of law - security, not penalty in all circumstances
Court reiterated that POCSO aims to protect children from sexual abuse, not to make every consensus relationship a crime.

🔹 6. Facts in depth examination necessary
Every case will depend on its facts—the court will not terminate the case without investigation based on agreement.

⚠️ Important Limitations):
👉 “Consent” under 18 years of age is not legally valid in POCSO
👉Court has also clarified that not every "near-majority" or teenage love relationship can be considered automatically

📢 A balanced approach of the court:
👉 Where there is exploitation → strict action
👉 Where real love relationship and no loss → Relief from judicial discretion
