अगर NCB किसी को पकड़ती है और वो जुर्म कबूल कर लेता है, तो क्या सिर्फ उस 'बयान' के आधार पर उसे 10 साल की सजा दी जा सकती है? 🧐⚖️

​अक्सर हम फिल्मों या खबरों में देखते हैं कि पुलिस के सामने बयान देना भारी पड़ता है, लेकिन कानून असल में क्या कहता है? Tofan Singh vs. State of Tamil Nadu (2021) के इस ऐतिहासिक फैसले में Supreme Court ने साफ़ कर दिया कि:

​✅ NCB ऑफिसर्स भी 'पुलिस' ही माने जाएंगे।
✅ Section 67 NDPS Act का बयान कोर्ट में सबूत (Evidence) नहीं है।
✅ बिना ठोस रिकवरी या स्वतंत्र सबूत के सजा नहीं होगी।

​अक्सर जब भी किसी Drug केस की बात आती है, तो हम सुनते हैं कि आरोपी ने "जुर्म कबूल कर लिया"। लेकिन क्या आप जानते हैं कि Tofan Singh vs. State of Tamil Nadu (2021) के ऐतिहासिक फैसले ने इस पूरे खेल को ही बदल दिया है?

​सुप्रीम कोर्ट ने साफ़ कर दिया है कि:

✅ NCB ऑफिसर्स भी 'पुलिस' ही माने जाएंगे।
✅ Section 67 NDPS Act के तहत लिया गया बयान कोर्ट में सबूत नहीं है।
✅ बिना ठोस रिकवरी या सबूत के सिर्फ 'Confession' के दम पर सजा नहीं होगी।
