𝗧𝗼𝗽-𝗨𝗽 𝗧𝗵𝘂𝗿𝘀𝗱𝗮𝘆𝘀 !

In a recent order, the Delhi High Court has directed several “rogue cyber locker websites” to take down copyright protected content. The order emanates from a plea of injunction filed by a host of entertainment companies including the likes of Universal City Studios Productions, Warner Bros. Entertainment, Amazon Content Services LLC, Disney Enterprises amongst others. The applicants claimed that these websites operate on the basis of an infrastructure that incentivizes unauthorized hosting, storing, streaming and sharing of copyrighted content. Additionally, the complainants also submitted that the websites function in a manner, that a new link to a piece of content is generated instantaneously upon being taken down from the website.

In its order, the Court has directed the defendants to take down all of the copyrighted content of the complainants coupled with disabling the features pertaining to re-generation of links to copyrighted content.

𝗧𝗼𝗽-𝗨𝗽 𝗧𝗵𝘂𝗿𝘀𝗱𝗮𝘆𝘀 !

Recently, the Delhi High Court has passed a dynamic+ injunction order and restrained various rogue websites from illegally streaming 𝗜𝗻𝗱𝗶𝗮𝗻 𝗣𝗿𝗲𝗺𝗶𝗲𝗿 𝗟𝗲𝗮𝗴𝘂𝗲 (𝗜𝗣𝗟) events without authorisation of Viacom 18. Justice Sanjeev Narula said that the legal remedies must remain robust and effective in curtailing copyright infringement, particularly in the fast-paced environment of the internet.

The court not only restrained these platforms from hosting, streaming, or making the IPL content available but also directed Domain Name Registrars to lock and suspend the identified websites.

In recent times, skill-based games with no element of luck can be offered without a licence in most Indian states besides Sikkim and Nagaland. Games of chance being offered for money are banned in a majority of Indian states under the current regulations, barring a select few states. In 2023, the Ministry of Electronics and Information Technology introduced the amended IT Rules, aiming to regulate and give stronger clarification for online gaming. The rules and subsequent amendments permitted online real-money games with regulatory approval.

Our Managing Partner, Mr. 𝗩𝗶𝗱𝘂𝘀𝗵𝗽𝗮𝘁 𝗦𝗶𝗻𝗴𝗵𝗮𝗻𝗶𝗮 states that the introduction of the IT Rules was seen as a landmark moment for the Indian online gaming industry and largely lauded by the industry. However, levying 28% GST on the value of all bets is a worrisome scenario. He further opines that after several representations, the government restricted the GST to just first-time deposits and not on every bet, but the industry still has strong concerns.

Recently, the Delhi High Court cancelled the trademark registration of the name ‘𝗗𝗼𝗹𝗺𝗮 𝗔𝘂𝗻𝘁𝘆 𝗠𝗼𝗺𝗼𝘀’ in the name of Mohammed Akram Khan after Dolma Tsering moved the court against Akram Khan for using their trademark.

They demanded the cancellation and removal of Khan’s trademark. And now, the Delhi High Court, while hearing his petition, has cancelled the registration of Akram Khan because Dolma Aunty has been running her stall under this name since 1994, and she has also trademarked it.

𝗧𝗼𝗽-𝗨𝗽 𝗧𝗵𝘂𝗿𝘀𝗱𝗮𝘆𝘀 !

Recently, a plea has been filed before the Supreme Court by an online travel company 𝗠𝗮𝗸𝗲𝗠𝘆𝗧𝗿𝗶𝗽, claiming that its trademark is being infringed through the Google Ads program. MakeMyTrip has raised a grievance over its business being diverted to a competitor through the use of such sponsored links. Meanwhile, Google is paid by the advertiser (𝗕𝗼𝗼𝗸𝗶𝗻𝗴.𝗰𝗼𝗺 in this case) every time an internet user clicks on such a sponsored link.

The plea by MakeMyTrip is an appeal against a December 2023 order of a division bench of the Delhi High Court, which held that such use of trademarks on the Google Ads program would not amount to infringement or passing off under the Trade Marks Act, 1999.

𝗧𝗼𝗽-𝗨𝗽 𝗧𝗵𝘂𝗿𝘀𝗱𝗮𝘆𝘀 !

The 𝗧𝗲𝗹𝗲𝗰𝗼𝗺 𝗥𝗲𝗴𝘂𝗹𝗮𝘁𝗼𝗿𝘆 𝗔𝘂𝘁𝗵𝗼𝗿𝗶𝘁𝘆 𝗼𝗳 𝗜𝗻𝗱𝗶𝗮 (𝗧𝗥𝗔𝗜) has completed the process of pre-conversation for a broadcast policy and is now almost ready with a detailed consultation paper that will be released within the next few days, as conveyed by its Chairman, Anil Kumar Lahoti. He shared that the first focus area is to encourage the production of local content. TRAI plans to make India a global hub for content creation and content publishing.

The next thing that TRAI is focusing on is how to have growth across all verticals of the M&E sector. The regulator will also work on making the regulatory climate and the policy environment more business-friendly and promote ease of doing business so that the sector grows.

On August 14, 2023, Mr. Kalyan Choubey, President of the 𝗔𝗹𝗹 𝗜𝗻𝗱𝗶𝗮 𝗙𝗼𝗼𝘁𝗯𝗮𝗹𝗹 𝗙𝗲𝗱𝗲𝗿𝗮𝘁𝗶𝗼𝗻 ("𝗔𝗜𝗙𝗙"), established a task committee to investigate the possibility of permitting PIOs and OCI to participate in the country's national teams. In order to determine the best ways to employ these players to advance Indian football, the task force will first assess the PIO and OCI footballers competing at a higher level, as well as the status of youth players. They will also establish a database and produce a report. On the other hand, this entire process has certain legal ramifications.

This article addresses the challenges involved in implementing the 𝗣𝗲𝗿𝘀𝗼𝗻𝘀 𝗼𝗳 𝗜𝗻𝗱𝗶𝗮𝗻 𝗢𝗿𝗶𝗴𝗶𝗻 (𝗣𝗜𝗢) card and 𝗢𝘃𝗲𝗿𝘀𝗲𝗮𝘀 𝗖𝗶𝘁𝗶𝘇𝗲𝗻𝘀𝗵𝗶𝗽 𝗼𝗳 𝗜𝗻𝗱𝗶𝗮 (𝗢𝗖𝗜) schemes, including the one that the AIFF is trying to carry out. This is consistent with the right to play sports and games as part of the "right to education," representation in international games as a PIO or OCI cardholder, and the policies implemented by the current All India Football Federation, to allow PIO and OCI cardholders to represent their nation.
