Landmark Judgment | Supreme Court on Misuse of Section 498A
In a significant ruling, the Supreme Court of India directed an IPS officer and her parents to issue a public apology to her ex-husband and his family, who suffered unjust incarceration—109 days for the husband and 103 for his father—due to false criminal cases filed under Section 498A.
The Court noted the severe mental and physical trauma caused and ordered the apology to be published in national newspapers and on all social media platforms within three days.
Though the apology won't count as legal admission of guilt, the Court:
✔️ Dissolved the marriage under Article 142
✔️ Granted custody of the child to the mother with supervised visitation for the father
✔️ Quashed all civil and criminal cases
✔️ Noted that the wife waived all claims to alimony and property
A strong message against misuse of legal provisions and a reminder of the power of fair justice.
