Maintenance to wife Whether the wife can be denied maintenance only on account of the fact that she is capable of earning Held that capable of earning’ and ‘actual earning’ are two different things.

Merely because the wife is capable of earning is not a sufficient reason to deny her the maintenance.

[Section 498A] Relatives living in distant places can also be booked for harassing wife: Bombay High Court

The High Court refused to accept the argument that since the in-laws and other relatives weren't residing with the couple, the allegations of cruelty and harassment can't be considered to be true.

The Nagpur Bench of Bombay High Court recently refused to quash a First Information Report (FIR) lodged against the relatives of a man in a Section 498A case, saying that many a time, relatives living in distant places also meddle in the affairs of a couple and harass the wife.

Ban Two-Finger Test On R**e Victims Forthwith : Madras High Court

The Madras High Court has directed the State Government to ban the practice of two finger test on victims of sexual offences by the medical professionals forthwith.

The bench of Justices R. Subramanian and N. Sathish Kumar issued this direction as it noted that the two finger test is being used in cases involving sexual offences, particularly, on minor victims even after the Supreme Court judgment which held that it violates the right of r**e survivors to privacy, physical and mental integrity and dignity.

Daughter not entitled to money from father if she does not want to maintain any ties with him: Supreme Court

Case Title: Ajay Kumar Rathee v. Seema Rathee [Civil Appeal 5141 of 2011]

A division bench of Justices Sanjay Kishan Kaul and MM Sundresh held that a daughter is not entitled to any amount from her father for her education or marriage if she does not want to maintain any relationship with him.

"In so far as the daughter’s expenses for education and marriage are concerned, it appears from her approach that she does not want to maintain any relationship with the appellant and is about 20 years of age. She is entitled to choose her own path but then cannot demand from the appellant the amount towards the education. We, thus, hold that the daughter is not entitled to any amount," the Court said in its order.

The Court also stated that in the instant case, the daughter is 20 years old and is free to choose her path but since she does not want to maintain any relationship with the father, she cannot demand any money from him for education.

notwithstanding the actual balance period of limitation
remaining, all persons shall have a limitation period of 90
days from 01.03.2022. In the event the actual balance
period of limitation remaining, with effect from 01.03.2022
is greater than 90 days, that longer period shall apply.
