Case Update:
Glad to share that the Hon'ble Uttarakhand High Court has issued notices in the writ petition argued by our founder, Rohit Arora relating to issuance of FORM SVLDRS-4 / Discharge Certificate under the SVLDRS, 2019.

The Petitioner tried to make the payment on 30/06/2020 but the same could not be made due to a technical error on bank's portal. However, the payment were made on 01/07/2020 bonafidely.

The Petitioner has also challenged the Audit Order wherein the demand issued pertains to the time period for which a declaration was already filed under the Scheme. The Hon'ble HC after considering the merits of the matter has issued notice and counter affidavit has been called from the Respondents.

Glad to share that in the case argued by our founder, Rohit Arora, the Hon'ble Uttarakhand High Court has quashed the demand intimation letters issued by the GST Dept. which directed the Petitioner to reverse the ITC amounting to Rs. 1.75 Cr on the basis that the supplier from whom the goods were purchased, has failed to deposit the tax to the Govt.

The Hon'ble HC has held that the provisions stipulated under section 73/74 read with rules should be mandatorily followed and no recovery can be done by any other means.
