हाल ही में CBI बनाम कुलदीप सिंह सेंगर मामले में सुप्रीम कोर्ट ने दिल्ली हाईकोर्ट द्वारा दिए गए ज़मानत आदेश पर फिलहाल रोक लगा दी। आमतौर पर सुप्रीम कोर्ट किसी को दी गई ज़मानत पर बिना उसे सुने रोक नहीं लगाता, क्योंकि ज़मानत व्यक्ति की आज़ादी से जुड़ा मामला होता है। लेकिन इस मामले में हालात सामान्य नहीं थे।

अदालत ने देखा कि आरोपी पहले से ही एक दूसरे गंभीर मामले में दोषी ठहराया जा चुका है। यह मामला आईपीसी की धारा 304 भाग-II से जुड़ा है, जिसमें मौत से संबंधित अपराध शामिल होता है। उस मामले में आरोपी अभी भी जेल में है और उसकी ज़मानत याचिका पर फैसला होना बाकी है। इसलिए, भले ही हाईकोर्ट ने एक केस में ज़मानत दी हो, लेकिन आरोपी की कुल स्थिति को देखते हुए सुप्रीम कोर्ट ने हस्तक्षेप करना ज़रूरी समझा।

सुप्रीम कोर्ट ने यह भी माना कि इस केस में कुछ महत्वपूर्ण कानूनी सवाल हैं, जिन पर आगे विस्तार से सुनवाई होनी चाहिए। इन्हीं विशेष परिस्थितियों को ध्यान में रखते हुए कोर्ट ने हाईकोर्ट के ज़मानत आदेश की कार्रवाई पर रोक लगा दी, ताकि आरोपी फिलहाल जेल से बाहर न आए।

इसके साथ ही कोर्ट ने पीड़िता के अधिकारों पर भी ज़ोर दिया। अदालत ने साफ कहा कि पीड़िता को अलग से सुप्रीम कोर्ट में अपील दायर करने का पूरा अधिकार है और इसके लिए उसे किसी विशेष अनुमति की ज़रूरत नहीं है। अगर पीड़िता आर्थिक रूप से सक्षम न हो, तो उसे मुफ्त कानूनी सहायता भी उपलब्ध कराई जाएगी।

इस आदेश से यह बात साफ होती है कि ज़मानत कोई अपने-आप मिलने वाला अधिकार नहीं है। हर मामला उसके तथ्यों और परिस्थितियों के आधार पर तय किया जाता है। अगर हालात असाधारण हों, तो अदालत सामान्य नियमों से हटकर भी फैसला ले सकती है। यह फैसला यह भी दिखाता है कि न्याय प्रणाली में केवल आरोपी ही नहीं, बल्कि पीड़ित के अधिकारों को भी उतनी ही अहमियत दी जाती है।

इस वक़्त वकीलों का आंदोलन क्यों चल रहा है, सबको पता होना चाहिए।

1 जुलाई 2024 को लागू किए गए नए क्रिमिनल कोड्स को सरकार ने बेहद आधुनिक और तकनीक-समर्थक बताया था। कहा गया था कि इनसे न्याय प्रणाली तेज़ होगी और आम जनता को राहत मिलेगी।

लेकिन 13 अगस्त 2025 को एलजी हाउस से एक आदेश जारी हुआ कि अब पुलिस गवाही के लिए थाने से ही वीडियो के ज़रिए पेश हो सकती है।

जैसे ही यह सूचना वकील बिरादरी तक पहुँची, इसे आम जनहित और न्याय प्रक्रिया के खिलाफ मानते हुए वकीलों ने इसका विरोध शुरू किया।

इसके बाद मजबूर होकर कॉर्डिनेशन कमेटी ने 22 अगस्त से सभी कोर्ट्स में हड़ताल करने का ऐलान किया। धीरे-धीरे हड़ताल ज़ोर पकड़ रही थी, लेकिन 28 अगस्त की शाम दिल्ली पुलिस की तरफ से एक लेटर जारी किया गया कि वकीलों की मांग पर गौर किया जाएगा और केंद्रीय गृह मंत्री अमित शाह बैठक करेंगे। इस आश्वासन पर आंदोलन को रोक दिया गया।

2 सितंबर को कॉर्डिनेशन कमेटी के मेंबर्स की मंत्री जी से मीटिंग हुई और उन्होंने कहा कि हम आपकी जो भी मांगे हैं वो ज़रूर मानेंगे। लेकिन 4 सितंबर को दिल्ली पुलिस की नई अधिसूचना आई जिसमें कहा गया कि औपचारिक गवाहियां थाने से ही होंगी, और केवल महत्वपूर्ण गवाह ही अदालत में पेश किए जाएंगे।

इस फैसले ने वकीलों के बीच गहरी शंका और असमंजस पैदा कर दिया। अधिकतर अधिवक्ता इस पूरे मामले की असलियत आसानी से समझ रहे थे।

फिर 6 सितंबर को BCI चेयरमैन मनन कुमार मिश्रा की चिट्ठी आई। वे, जो राज्यसभा सांसद भी हैं और लंबे समय से अपने पद से चिपके हैं, दावा कर बैठे कि सारे मुद्दे सुलझ चुके हैं और अब बार-बार हड़ताल करना केवल वकीलों की छवि को नुकसान पहुँचाएगा। दरअसल उनकी कोशिश खुद को और अपने करीबियों को लाभ पहुँचाने की अधिक प्रतीत होती है, न कि वकीलों की ताक़त बढ़ाने की।

यह चिट्ठी वकील समुदाय के आत्मसम्मान पर चोट जैसी थी। तत्काल सभी कोर्ट की बार एसोसिएशन और नेताओं ने आपात बैठक बुलाई और 8 सितंबर की हड़ताल को सर्वसम्मति से फिर से पुख्ता कर दिया।

किसी भी आंदोलन की सबसे बड़ी कमजोरी अंदर से ही आती है। ऐसे लोग जो व्यक्तिगत स्वार्थ से समझौता कर लेते हैं, पूरे संघर्ष को कमजोर कर देते हैं। इस बार हमें शुरू से ही उन चेहरों की पहचान करनी होगी और उन्हें आंदोलन से अलग रखना होगा।

केवल एकजुट होकर ही हम सरकार को मजबूर कर सकते हैं कि वह इस नोटिफिकेशन को वापस ले।
