⚖️ क्या है पूरा मामला?

Delhi High Court का एक important judgment आया है —
Sandeep Goel v. Zavenir Developers Pvt. Ltd.
5 June 2026 | 2026 DHC 5089

अब इसे आसान भाषा में समझिए 👇

💰 एक व्यक्ति ने ₹50 लाख का loan लिया।

बाद में एक document पर उसने outstanding amount की confirmation कर दी।

जब पैसे वापस नहीं मिले, तो सामने वाली party ने Order 37 CPC के तहत Summary Suit file कर दी।

👨‍⚖️ Defendant ने कहा:

“मेरे और उनके बीच कोई formal loan agreement तो बना ही नहीं था…
फिर Order 37 की Summary Suit कैसे?”

🔥 लेकिन Court ने कहा — सिर्फ formal agreement न होने से मामला खत्म नहीं हो जाता।

अगर आपने किसी document पर sign करके यह confirm किया है कि—

👉 पैसा लिया था
👉 कितना पैसा बाकी है
👉 interest कितना है

तो ऐसा signed confirmation written agreement/contract की तरह काम कर सकता है।

⚠️ और सबसे important बात—

Order 37 में defendant को automatically full trial का अधिकार नहीं मिल जाता।

उसे Court से Leave to Defend लेना होता है।

और अगर उसका defence सिर्फ बहाना है, और कोई genuine triable issue नहीं दिखता…

🚨 तो Court defence की permission refuse करके सीधे decree दे सकती है!

TAKING PICTURES IN PUBLIC. IS THIS LEGAL??

* In a genuinely public place, simply appearing in the background of someone’s photo/video does not automatically mean the recording is illegal. The Supreme Court has said that a person’s expectation of privacy can be lower in a public setting, but importantly, privacy is not completely lost merely because someone is in a public place.
* If someone is deliberately filming you or your family, repeatedly following you, focusing on private/intimate activity, harassing you, or using the footage in a harmful or defamatory way, the legal position can be very different.
* Posting the video as a reel is also different from merely recording it. Context, purpose, whether identifiable personal information is exposed, and how the footage is used can matter. India’s data-protection framework also treats personal/domestic processing differently from broader publication/use.
* Places such as schools, hospitals, changing rooms, residential premises, courts, or privately controlled venues can have additional restrictions or rules.

So if someone is making reels/videos of you and your family in public without asking, I wouldn’t say “it’s always legal” or “it’s always illegal.” The specific circumstances matter.

VIRTUAL INFIDELITY — CAN AN ONLINE AFFAIR BECOME A LEGAL ISSUE?

sending heart emojis…
having secret calls…
but says, ‘We never met in person.’

So… is it really cheating?” 👀

This is commonly referred to as “Virtual Infidelity.”

It means maintaining a romantic, emotional, or intimate connection with someone online—through messages, social media, video calls, or other digital platforms—while keeping it secret from your spouse.

But here’s the interesting legal question:

Can an online affair be a ground for divorce in India?

The answer is — not that simple.

Adultery is no longer a criminal offence in India.
However, depending on the facts, online conduct may become relevant in matrimonial proceedings, including allegations of mental cruelty.

The court would look at the nature of the conduct, its extent, and its impact on the marriage.

So remember:

“It was only online” does NOT automatically mean “it has no legal relevance.
