🚨 Police entered her BEDROOM at 11:30 PM. No lady constable. No warrant procedure. They just took her phone.
The Bombay High Court's answer? Illegal. 🔨
Justices Urmila Joshi-Phalke & Nivedita Mehta didn't hold back:
"Investigation cannot legitimise an otherwise illegal search or seizure."
Here's what went wrong 👇
📵 Her phone was seized WITHOUT following Section 105 BNSS (no proper seizure memo, no independent witnesses)
🚪 Police entered her bedroom WITHOUT a woman constable — a direct violation of Section 185 BNSS
⚖️ The Court ruled this was a serious invasion of her privacy and dignity under Article 21
Result: State of Maharashtra ordered to pay ₹10,000 compensation — and recover it from the officers who did this.
