The Delhi High Court has asked HDFC Bank and the Reserve Bank of India (RBI) to respond to a case where โ‚น74.6 lakh was fraudulently withdrawn from a customer's account.

Manmohan Kumar, the account holder, said his phone number and email linked to the account were changed without permission. He also claimed a virtual debit card was created in his name without his knowledge.

While HDFC initially refunded the money, it later reversed the refund, stating that the transaction was legitimate. Kumar then approached the RBI, but it ruled in favour of the bank.

Unhappy with the outcome, Kumar has now taken the matter to the High Court, alleging serious lapses by the bank. The case is being heard by Justice Vikas Mahajan.

The National Human Rights Commission (NHRC) has initiated an inquiry following a disturbing incident in a private school in Khubbapur village, Muzaffarnagar district, Uttar Pradesh. A student was reportedly subjected to a beating orchestrated by his teacher, who made derogatory faith-based comments, leading to his classmates attacking him. The incident, captured in a viral video, has sparked public outrage and calls for swift action against both the teacher and the school.

The boy's family revealed that the assault was triggered by a mistake in multiplication tables during a class session. The NHRC has taken a stern stance, viewing the incident as a grave violation of human rights if proven true. To address the matter, the Commission has issued notices to the Chief Secretary and the Director General of Police, Uttar Pradesh, demanding a comprehensive report within four weeks. The report should encompass details on actions taken against the teacher, the status of the filed FIR, compensation provided to the affected family, and preventative measures to forestall similar incidents in the future.

As of August 28, 2023, the teacher, who also owns the school, remains unarrested. Additionally, it has come to light that the school does not meet the Education Department's requirements. In response to the incident, the boy's family has withdrawn him from the school, actively seeking an alternative educational institution. Public attention remains focused on the developments as the NHRC endeavors to ensure justice and prevent the recurrence of such reprehensible incidents.

Reports have surfaced regarding severe human rights violations in the town of Hajipur, necessitating urgent attention from authorities. Saurav Narayan, a concerned LL.M. graduate from the Central University of Punjab, has penned a compelling letter to the Bihar Human Rights Commission, urging them to swiftly address these pressing concerns.

Saurav Narayan letter sheds light on the critical issue of inadequate healthcare facilities in Hajipur. Basic access to health services is being denied to the town's residents, leaving them vulnerable and distressed. This violation not only disregards their well-being but also infringes upon their inherent right to life and health.

Transportation services within Hajipur have also been significantly disrupted, causing immense inconvenience and hampering the mobility of local citizens. This disruption goes against the guiding principles of the National Human Rights Commission (NHRC) and compounds the challenges already faced by the community.

A particularly alarming concern is the widespread environmental pollution depicted in video footage provided by Prabhat Khabar, Sewage water visibly contaminates the streets, posing serious threats to public health and the environment. Legal precedent, such as the 1980 Supreme Court case of Municipal Council, Ratlam vs Shri Vardhichand & Ors, underscores that the right to life encompasses the right to a clean and healthy environment, empowering individuals to demand protection from the government.

In light of these violations, Narayan passionately urges the Bihar Human Rights Commission to take immediate action. The Commission's intervention is of utmost importance to protect the human rights of Hajipur's residents and ensure the provision of basic necessities for a life of dignity.

Narayan has thoughtfully included video evidence that vividly portrays the dire circumstances in Hajipur, providing a compelling visual representation of the urgency of the situation. The Bihar Human Rights Commission is implored to conduct a thorough investigation into these concerns and to implement effective measures to rectify the violations while also proactively preventing their recurrence. A petition has been filed before the Patna High Court challenging the recruitment notification of Bihar State Mining Corporation Limited for the post of Law Officer on the ground that it allows only the law graduates from the Chanakya National Law University, Patna (CNLU) to apply for the said post.

Essentially, the Mining Corporation Limited issued a letter to the CNLU Vice-Chancellor on December 16 for the purpose of engaging 10 law students for the post of Law Officer, pursuant to the same, the University administration informed its students about the said post and asked the interested students to apply by way of submitting their CVs and other details.

Aggrieved by the same, Saurav Narayan, a law graduate of the Delhi University (Law Centre-I, Faculty of Law) sent a representation against this proposal to the CEO of the Corporation, however, no action was taken on the same and therefore, Narayan has now moved the High Court with his writ petition through Advocate Vishal Kumar Singh.

Against this backdrop, the plea prays thus:

)Direct the Respondent Authorities to immediately revoke the offer letter dated 16.12.2021, wherein the Registrar of the CNLU has been requested to send a list of 10 Law Graduates from the University for appointment on the post of Law Officer in Bihar State Mining Corporation Limited.

)Direct the Respondent Authorities to initiate fresh appointment process for the post of Law Officer in Bihar State Mining Corporation Limited which should be open for all candidates to apply irrespective of the University from where they have completed their Law degree.

)Direction to the Respondent Authorities to ensure that the adequate reservation procedure is followed as per the guidelines issued by the Hon'ble Supreme Court of India in the case of Indira Sawhney v. Union of India, A.I.R 1993 SC 477.

RIT Foundation v. UOI and other connected matters

Irrespective of marital status, every woman has the right to say no to S*x: Delhi High Court

โ€œJust because she is married, does she lose her right to say โ€˜noโ€™?โ€

The bench said, โ€œIs the firewall justifiable on the test of Articles 14 and 21? It is only that narrow aspect that we have to look into. To say that the wife can go and seek divorce if the husband imposes himself on her is not the issue here." โ€œWhy is it so different from an unmarried woman? It affects an unmarried womanโ€™s dignity but it does not affect the dignity of a married woman How is it? What is the answer to this? Does she lose her right to say โ€˜noโ€™? Have 50 countries (which have made marital r**e an offence) got it wrong?" it asked.
