At the recently-concluded Annual Arbitration Conference, Steven Lim, 39 Essex Chambers, analysed the famous Ssanyong case to explore the Indian approach to modification and setting aside of awards. He also highlighted that Justice Nariman thoroughly discussed various international case laws and principles. However, the Court invoked Article 142 of the Indian Constitution in deciding the case. At the 12th Annual Arbitration Conference, our speakers, while appreciating the Indian legal system, also pointed out the gaps in the amendments to the Arbitration and Conciliation Act, 1996. They also observed that the 2015 Amendments are by-products of earlier judgments, including those involving claims under Section 36 of the Arbitration Act, read with Section 34.
