Please read this reportable judgment passed by the Hon’ble Supreme Court of India. I ( Mrunal Buva, Advocate, Supreme Court of India, Mrunal Buva) have argued this matter seeking quashing of an FIR u/section 376, 506,504 & 420 of IPC. While allowing the criminal appeal , Hon’ble Court quashed an FIR & has acknowledged me in para 10 of the Judgment. Salunkhe, Adv. Supreme Court of India also appeared with me in the said matter.

A bench of Justices B V Nagarathna and N Kotiswar Singh said while quashing an FIR against a man accused of r**e by a woman who was in a relationship with him for over 9 years.

Unless it is shown that the physical relationship was purely out of the promise of marriage, it cannot be said that consent was vitiated due to misconception of fact, the Court said.

The Supreme Court has expressed concerns about the "worrying trend" of invoking criminal law against men on allegations of r**e on the false pretext of marriage after a long consensual relationship turned sour.
