Family Court Must Consider WhatsApp Chat Indicating Adultery Even Without Section 65-B Certificate: Allahabad HC Sets Aside Maintenance.

The High Court of Judicature at Allahabad has set aside a maintenance order, observing that a Family Court possesses the discretion to receive any evidence that assists in effectively adjudicating a dispute, irrespective of its strict admissibility under the Indian Evidence Act.
The Single Judge Bench of Justice Madan Pal Singh, while allowing a criminal revision, held that the trial court erred in summarily ignoring WhatsApp chats alleging adultery solely due to the absence of a certificate under Section 65-B of the Indian Evidence Act.

पत्नी शिक्षित है तो भी गरिमापूर्ण जीवन सुनिश्चित करना पति का कर्तव्य: सुप्रीम कोर्ट ने स्थायी गुजारा भत्ता बढ़ाया.

सुप्रीम कोर्ट ने एक महत्वपूर्ण फैसले में कहा है कि तलाक के बाद पत्नी को उसी जीवन स्तर के साथ जीने का अधिकार है जैसा वह शादी के दौरान अपने पति के घर में जी रही थी। शीर्षअदालत ने स्पष्ट किया कि केवल इस आधार पर कि पत्नी शिक्षित है या उसे माता-पिता का सहयोग प्राप्त है, पति का यह दायित्व समाप्त नहीं हो जाता कि वह उसे गरिमापूर्ण जीवन जीने में मदद करे।

Delhi: Court convicts 3 including MCD Engineer for demanding bribe for house construction

NEW DELHI: The Rouse Avenue court has recently convicted three people, including MCD's Junior Engineer, for allegedly demanding and accepting a bribe for allowing the construction of a house.

It was alleged that the complainant was threatened if the demand was not fulfilled.

Arrest Illegal If Reasons Not Informed; When Art 22(1) Is Violated, Court Must Grant Bail Despite Statutory Restrictions : Supreme Court

Noting that informing an arrested individual of the grounds for their arrest is a fundamental right under Article 22(1) of the Constitution, the Supreme Court today (February 7) stressed that this information must be conveyed clearly and effectively. The Court also emphasized the magistrate's duty to ensure compliance with Article 22(1) during remand, noting that any violation could warrant the person's release or justify the granting of bail, even in cases with statutory restrictions.

"Even if statutory restrictions on grant of bail exist, the statutory restrictions do not affect the power of the court to grant bail when violation of Article 21 and 22 of the Constitution is established.", the Court observed.

Order 7 Rule 11 CPC | Limitation Arises From Date Of Knowledge Of Essential Facts, Not From The Date Of Registration.

The Supreme Court has held that limitation arises from the date of knowledge of essential facts when a suit for cancellation of a sale deed is opposed through an application under Order 7 Rule 11 of the CPC.

The Court set aside the order of the Gujarat High Court after observing that there was no justification for the High Court to hold that the limitation period commences from the date of registration itself.

The Bench of Justice Pamidighantam Sri Narasimha and Justice Manoj Misra observed, "High Court was also not justified in holding that the limitation period commences from the date of registration itself. In this view of the matter the judgment of the High Court is unsustainable.."

A bench comprising Justices Rekha Palli and Saurabh Banerjee, in its December 16 order, observed, "The said settlement having not been acted upon, the same could not be treated as binding either on the appellant (wife) or the respondent (husband)."

The court was hearing an appeal filed by a wife against an April 15 order by a family court that denied her interim maintenance. The family court had ruled that the wife was bound by the settlement terms finalised on December 1, 2012, despite the settlement never being implemented. The high court deemed this reasoning flawed, stating that the wife could not be deprived of her statutory right under Section 24 of the HMA.

A 35-year-old man from Dholka taluka in Ahmedabad died by su***de after finding his wife having sexual relations with her brother.

As per the FIR lodged by the father of the deceased, his son first married a woman from Dholka in 2009 and got divorced in 2017.

The father stated that he did not have a good relationship with his son and had started living separately. Due to this, the complainant had announced through the newspaper that he was no longer related to his son.

The man married the woman in February, who had already married and divorced four men before him. They moved to Dholka together.

The local police informed that his son attempted to end his life by consuming poison and was admitted to a nearby hospital. As his condition deteriorated, he was shifted to Asarwa Civil Hospital, but later died on November 7.

The complainant found a letter in his son's pocket stating the reason by alleging his wife had a sexual relationship with her brother.

The letter states that 'around three months ago, he saw his wife in a compromising situation with her brother. He was shocked and raised concern for this matter. Later his wife and her brother physically assaulted him and threatened him. Her previous marriages were ended due to the same reason.'

The police is further investigating the matter.

The Delhi High Court on Monday held that a wife's right to reside in the shared household under the Protection of Women from Domestic Violence Act, 2005 (DV Act) is not absolute.

Justice Neena Bansal Krishna noted that if a wife is gainfully employed, she may be evicted from the shared household (the house where a woman comes to reside after her marriage irrespective of who has ownership of that property) in accordance with the law.

The Court made the observation in one such case where an estranged wife was found to be employed and not so helpless that she needed to continue residing in her marital home.

"No absolute right of residence can be claimed by the petitioner. She herself is an educated woman who has done her MBA and is employed with Accenture Solutions Private Limited. It is not a case where she is helpless or there is any endeavour to leave her on the road by taking away the roof from her head," the Court observed.

The Supreme Court on Friday closed the proceedings in a Habeas Corpus petition filed by a father alleging that two of his daughters had been "brainwashed" to reside at spiritual guru Jaggi Vasudev's Isha Yoga Centre in Coimbatore.

"We had spoken to both the ladies. Both of them said that they are living there on free will and we need to close the Habeas Corpus plea," CJI Chandrachud said.
