In “Yogendra Pratap Singh v Savitri Pandey” Criminal Appeal No. 605 of 2012, the SC has held that a complaint filed before the expiry of 15 days from the date of receipt of notice issued under clause (c) of the proviso to Section 138 is not maintainable. This puts us in a quandary especially since filing physical as well as electronic has resumed in many places. Damned if you do-damned if you don’t. If the complaint is filed after 15 days from notice and the period of payment is taken to be extended, the complaint becomes pre-mature and not maintainable. If the complaint is filed after waiting for the prescribed period of 15 days after the limitation begins to run, and presuming that the SC will grant a period of 15 days after lifting of the lock down in line with the earlier order, the end of the prescribed period will coincide with the end of the extension of the limitation period and complaint will be time barred.
To conclude, it appears best, as on today, to not rush in filing a complaint under Section 138 of the NI Act, 1881 though physical filing has resumed for non-urgent matters in Delhi and wait for appropriate orders by the Supreme Court which in all probability are likely to be passed

Will or Wasiyat as it is called in vernacular, is a document which decides the fate of one’s movable and immovable property after one passes away. Since time immemorial it is considered to be a very important document for a person and his family. Often, we have received queries, especially from Senior Citizens, regarding the legal aspects of wills e.g. whether it should be registered or not, how is it to be executed, etc. This issue becomes even more relevant in today's time, when uncertainty and insecurities in life have increased due to pandemic COVID 19.

In pursuance of above, on 25.06.2020, DLSA Shahdara organized a Legal Awareness Programme on the topic Creation of WILLS: Do’s & Don’t’s for Senior Citizens through Video Conferencing App (CISCO WEBEX) from 12:30 P.M. onwards. This Webinar shall laid emphasis on how to make Wills, whom to approach for paperwork, if required and legal aspects.

The Resource Person of the abovementioned Legal Awareness Programme wss Mr. Karan Jain, Advocate, Founding Partner, Virtuous Legal who had an interactive session with the participants.
