📜 Court Ruling: No Attempt to R**e, But Aggravated Sexual Assault 🚨
🛑 Allahabad High Court Modifies Charges in POCSO Case

📌 Case: Pawan & Akash v. State of U.P.
📌 Citation: Allahabad HC, 2024

🔍 Key Observations by the Court:
🔹 The accused allegedly grabbed the breasts of the victim, broke the string of her pyjama, and tried to drag her beneath a culvert.
🔹 The district court initially framed charges under Section 376 IPC (R**e) & Section 18 POCSO (Attempt to R**e).
🔹 The Allahabad HC ruled that these acts do not constitute an attempt to r**e, as the prosecution must prove that the offense went beyond mere preparation.
🔹 Instead, the court held the accused liable under Section 354-B IPC (Assault or Use of Criminal Force to Disrobe) & Sections 9/10 POCSO (Aggravated Sexual Assault).

⚖️ Justice Ram Manohar Narayan Mishra observed:
"To establish an attempt to r**e, the prosecution must prove that the act had gone beyond the stage of preparation."

🚨 What to Do If Police Refuse to Register Your FIR? 🚨

If the police refuse to register your FIR, don't lose hope! Here's what you need to know:

1️⃣ FIR in Cognizable Cases
- An FIR is mandatory for cognizable offenses (e.g., murder, r**e, theft), as per Section 154(1) of the CrPC.
- These are serious offenses where the police can investigate without prior approval from a magistrate.

2️⃣ No FIR in Non-Cognizable Cases
- For non-cognizable offenses (e.g., defamation, public nuisance), it's not mandatory for the police to register an FIR immediately.
- The police will need magistrate approval under Section 155(2) of the CrPC before proceeding with the investigation.

3️⃣ Your Rights When FIR is Denied
- If the police refuse to register an FIR, you can directly approach a Magistrate under Section 156(3) of the CrPC. [R.W sec.173 of BNSS]
- The Magistrate can direct the police to investigate your complaint if deemed appropriate.
