The right to privacy won't come to the rescue of a spouse indulging in an extra-marital affair, Delhi High Court said on Wednesday and allowed the plea of a wife to access CCTV footage and payment records of a hotel where the husband stayed with a female colleague on an outstation trip to Jaipur.
The Hindu Marriage Act specifically recognizes adultery as a ground for divorce and therefore, it would not at all be in public interest that the court should on the ground of right to privacy, come to the aid of a married man who, during the subsistence of his marriage, is alleged to have indulged in s*xual relationships outside his marriage," Justice Rekha Palli stated.

The Madhya Pradesh High Court ruled that the Petitioner (wife) did not make out any case of hardship or inconvenience.

Further, the Respondent (husband) has agreed to bear the travelling expenses of the Petitioner. It was also observed that the Petitioner did make an appearance before the Trial Court without any protest.

Hence, the transfer petition filed by the wife was rejected by the High Court.

The Madras High Court has called upon the Bar Council of Tamil Nadu to take stringent disciplinary action against Advocates for conducting marriage ceremonies in their Chambers and issuing invalid/ fake Marriage Certificates.
High Court's Observation:
The Court at the outset wondered as to how the Advocates are authorized to perform special marriages in their office or Trade Union and mentioned that when previously such matter came up, the court categorically held that marriages performed in secrecy in the Office of Advocates and Bar Association Rooms cannot amount to solemnization within the meaning of Sections 7 and 7-A of the Hindu Marriage Act, cannot be used as a sword by the males for cutting the nuptial knot in matrimonial proceedings, but can be used only by the fair s*x to get liberated from sham marriages of this nature.
