In the matter of Steel Authority of India Ltd v British Marine PLC, O.M.P. (COMM) 20 of 2023, vide judgment dated 13.10.2025, the Hon'ble High Court of Delhi dismissed SAIL’s Section 34 petition and affirmed the majority arbitral award dated 13.09.2018.
It was held that “issue conflict” is not a statutory ground of ineligibility. Prior participation of two arbitrators in another arbitration on a similar clause did not, by itself, show bias or a closed mind, and non-use of a particular disclosure format did not vitiate the mandate.
On merits, the Court endorsed the Tribunal’s contractual reading, rejected a belated force majeure theory, and sustained a market differential measure for damages along with pre-award and post award interest in line with Section 31(7) of the Arbitration and Conciliation Act, 1996.
